      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

UNREAL!!! Have finally got through to them on the phone, apparantly I am not to be offered any GOGW payment, this paragraph on the letter is a mistake !!!!!!

WHAT??? They've got to be winding you up! You now have it in black and white that they are refunding your charges (exactly which ones we're not sure, but lets not be picky :rolleyes: ) Surely their error is not your problem? What about contacting Customer Satisfaction Dept? And get the court claim done - quick!

I certainly feel wound up! I have emailed a complaint to the chap who apparantly sent me the letter (a Mr Frank Reilly) I guessed his email address to be [email protected] and it hasn't bounced back, so we will have to see what happens.

 

This is the email I sent:

Dear Sir,

I received a letter from yourself this morning, dated 22.6.07

 

I would like to draw your attention to the 9th paragraph, and I quote

 

"As we have cancelled the charges as a gesture of goodwill and not due to an Abbey error, I am unable to alter any information held with a credit reference agency, as this information is factual. It is however unlikely that any adverse information has been registered against you in connection with this matter"

 

Since receiving this letter, I phoned up the number on the top of the letter (0845 600 6014) and spoke to two people in this department. The first person was very helpful, but unable to look in depth to my query as the computers were "down", he did however agree however that the above paragraph sounded as if my charges were cancelled/reversed and I was due to receive a refund. He advised me to phone back in a while when the system was running correctly again. This I did, and spoke to another adviser, who explained to me my case had been reviewed, I was not going to be offered any gesture of goodwill and the above paragraph was a mistake, that the letters sent out are taken from a template and the statement above was added in error.

 

I cannot help but think that my case has not been taken seriously as I have received information in the post which has been immediatly contradicted on the telephone.

 

It is my intent to complain to the OFT about this letter, and I also intend to file at court to settle this matter without any further delay. Obviously this will cost Abbey a further 8%,

 

I was truly hoping that Abbey would be reasonable about this matter, I had even emailed a few days ago and offered to settle for an amount less than I had initially claimed for, to save time, expense and trouble on both of our parts.

and typically, I have not had a reply or acknowledgment... I am going to re-send this letter in the post tomorrow... Cant file at court till next week when I get paid...

Time to do something was this one. I didnt take it to court because by the time I had money the stays were happening.

I have just won my claims with B'card for charges and PPI so am feeling positive. I did this via the FOS.

Was thinking about sending my Abbey stuff to the FOS too, I realise they will not do anything with it till after the stays but at least they will be in the system.

Maybe the letter they sent me that had the paragraph in "error" might be useful here?

Since I last posted on this thread - I have had some major family issues (now resolved) some major health issues (also now resolved) and I moved house. I did not take this any further.

 

 

I intend to try fighting this one again - stating in the first instance the amount of money taken from my account, the financial difficulties it placed us in, eventually my husband declared himself BR due to ill health/pressure/depression

 

 

At the time these charges were being taken, I had 3 children at school - I was receiving child benefit and a small amount of tax credit. My letter in the first instance will relate to our benefits being swallowed by unreasonable charges, we lived off credit that we could ill-afford - the end result being major financial problems. I intend to write to the bank with this info, informing them that I am going to take this information to the FOS and ask them to look into it on my behalf.

 

 

I am out of the loop on here - but glad to be back! Any suggestions/hints/tips welcome. Thank you
