    • You MUST use the paypal resolution to get your money back, he can sue DPD if he wishes. It isnt YOUR turntable until you have accepted it and you mkade it clear to the courier that you werent. Yes, the seller is massively inconvenienced but he decided who to use to send it so he has to make the decisions. Dont be out of pocket because you feel sorry for someone, they know the score and DPD might not like being sued in Holland so will settle with him anyway wheras they will fight you tooth and nail. I know, I have sued a carrier, won the court case and they appealed and lost but still wouldn pay up so started bankruptcy proceedings and they had to go abck to court agin. The costs were more than the settlement and that was thousands more than you are after even though the original problem coud have been settled for a few quid
    • i could contact BRSs again they will only get their own builders, I'm ok with this they are probably going to let me down again thou.   I'm going to have to forget about the gate and hide it out the way as a builder is going to run a mile because they wont be bothered in getting a metal worker involved.   I've had one builder come down he  obviously wasn't interested,  to complex for him he never come back to me with a quote Another builder i sent pictures online and he never contacted me either.   A cash settlement would be easier but I'm not pushing for it. With cash i could use the services of a builder and metalworker. the hinges need to be welded on to a metal rod and the bricks built around it, the gate i can just tart it up a bit and accept the damage.
    • Hi and thank you for your advice.   No, nothing out of the ordinary and nothing made to measure.   I have put something in writing which I will hand deliver to the store tomorrow and I have also emailed them stating I have been told that I cannot cancel.   They are getting someone to call me back this evening apparently so I will check with them again.   Thanks again. I was having a sweat then as I really have changed my mind about this particular suite. I could see myself stuck with it! 🙄  
    • Just to qualify – as long as it's not a made-to-measure sofa or in some way modified specially for you. You should be recording your calls. You shouldn't be doing this kind of thing on the telephone without having the evidence of the conversation – both sides – particularly that they rejected your cancellation of the order. Also you should write to them – refer to the telephone conversations that you've had and the fact that they have refused and point out that this is contrary to the distance selling rules and that you are asserting your right to a 14 day cooling off period. Don't forget, that if the sofa is at all modified for you or made-to-measure then you don't have this right
    • You dont have to sign a contract, working for someone and agreeing to certain conditions create an implied contract. All matters that are the law of the land such as health and safety are part of that inplied contract so no employer can claim  otherwise. The contract was created by working there for more than a month. If they havent actually given her written terms or they arent available on the intranet as an alternative them they have broken the law and that give your wife a bit of leverage and a ci[ple of weeks pay when she drags them through the Employment Tribunal.   the wording you have just posted amkes her resignation correctly doen and they cant tell her to go earlier unless they want to pay her off. Wha she needs to do is remind them that her letter does fulfil her contractual obligations and she expects to leave on that date or be paid off for her notice period. she should let them know that she is willing to take the matter to an ET if necessary. They are currently not paying her, the govt is but they will have to pick up the tab for a month hence their desire to persuade her she is wrong

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hello All

 

I sent a DPA request to EGG using the standard template. I sent £10 as stated in the letter. However, I received a letter from them on the 4th May asking for proof of ID.

 

"Identification

 

Any of the documents listed below may be used for this purpose:

- A bank, building society or credit card statement

- A store card or catalogue statement

- A utility bill

 

The document must be an original, not a photocopy, and dated within the last 3 months. It must show your full name or first initial and surname and your current address. All documentation will be returned to you. If you are unable to provide any of the above items, please attach a letter confirming your identity. This must be an original, typed on headed paper, dated within the last three months and authenticated with an official stamp if applicable. It should be from your employer, solicitor or other professional body or person."

 

I therefore sent them a bill for my Orange mobile phone. However, I received this back with another letter saying that they are "unable to carry out your request because you have not provided the required identification document(s).". This letter now only shows the 3 items as bullet pointed in the above statement as being acceptable forms of ID and asks me to fill out "the form" and return these items using the pre-paid envelope.

 

There is no form or pre-paid envelope...

 

I also remember seeing somewhere that the fact that my address that I am using to correspond with them is the same as the one they hold on their system for my account should infact verify that I am said person. Unfortunately I can find this thread again so can't use the advice or template that was given. I also don't have any utility bills, store cards or catalogue statements for this address and I don't want to send other banks details to them.

 

Any advice would be much appreciated on this matter.

 

On a side note is the 40 days still ticking??

Unfortunately they have discovered another delaying tactic.

 

They can demand ID within the legislation, and the clock starts from when they receive it. The only thing I would say is if they waited more than about 10/14 days before asking for the ID, you could claim that they were trying to stall your request, and threaten that you will contact the IC.

When I contacted Egg, I always did it through their online secure messaging service. If they then request ID you have a sure fire complaint to publicise because that is then them effectively saying that they don't trust their own secure messaging system. If not strictly within the DPA surely this would be highly embarassing for them... :D

I've just sent the following email via their Secure Messaging Service. Thanks for the advice dinghy.

Further to your letter dated 10th May 2006 I am writing to you via your Secure Web Messaging service to confirm that I XXXXXXXXXXX of XXXXXXXXXX wish to confirm my identity for the purposes of my written request for a Subject Access under the Data Protection Act dated 26th April 2006.

 

Details on your own website state that I can use the Secure Messaging Service to request this service as quoted below.

 

"What products and services can I use secure messaging for?

You can communicate with us using secure messaging about all of our products and services, even ones you don't currently hold."

 

As the address that I require the DSIR to be sent to is the same address that you currently hold on your files in relation to my accounts, and the fact that I provided an original Orange PCS statement showing my name and the above address following your letter dated 4th May 2006, and the fact that I have responded to both your letters of inquiry for validation of identity, and the fact that I am using your own secure messaging system which verified my person at login, is more than enough validation of the fact that I am the one and the same XXXXXXXXXXXX who resides at XXXXXXXXXXXXX.

 

Please therefore continue with the DSIR that I submitted as requested. I am taking this email as more than satisfactory verification of my person and you have 40 days from this date,16th May 2006, with which to comply. Failure to take this email as such verification of my identity and my address will be seen as yourselves effectively saying that you don't trust your own secure messaging system, a matter with which I will happily take further.

It seems to have worked. The cheque I sent to egg was cashed today!!
