      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

silly question feom me before i even begin. I am printing out my SAR letter this morning and just need to know if I have to leave in the copyright line at the bottom of the template or do I remove it. Could someone please advise.

The template I used didn't appear to have a copyright line in it. All S.A.R - (Subject Access Request)'s say pretty much the same thing so I can't imagine anyone is going to be particularly upset at you using their template and removing the copyright notice.

had a reply from Payplan giving me two letter templates to approach the bank for replayment of charges, so I take it that they do not object to me going after Lloyds ( i will have questions about this claim later, but I will start a new thread in the Lloyds section).

Well after NatWest letter of yesterday, ny statements turned up his morning (wrapped in plastic by the PO and a sticky label to say 'sorry your post is damaged') and I have spent the last three hours going through them and adding the charges to the spreadsheet. I have decided that i will be claiming contractural interest at Natwest rate of 29.65%

 

Just a quick question - on the spreadsheet it has a column for 'estimated overdrawn balance during period of interest' would that figure be for the date that nat west specify - the statement says

 

31 jan - interest 01 jan a/c xxxxxxxx 0.32

 

do i work out the average overdrawn amount for the month or for the previous month or just use the figure at 31 jan when the charge was applied. Sometimes when the charge is applied the account is in credit.

 

any help please?

 

with interest i will be claiming £4286.87 and rising (haven't checked my account today). that amount is from july 03 to feb 07. If only I could get my hands on the statments before 01 because from 01 to o3 the account was dormant it was actually opened in around 1987 and there is a shed load of charges before 01, but hey, that may be another battle for another time.

 

Now if LLoyds bank would only respond to my S.A.R - (Subject Access Request) (subject access request) as quickly as Nat west.

good evening everyone

 

I have been trawling thorugh the website in search of a template for a prelim letter claiming the contactural interest, all i can find is a paragraph to add to the basic template in the template library, although I have seen mentioned that there were plans to have a specific template for those wanting to claim the contractural interest.

 

Does anyone have any idea of where I can find the template please? or should i just go ahead and amend the one that is already there?

 

Any help gratefully received - want to get this right from the very beginning.

another question-

 

I did not get anything mentioning manual intervention with my six years worth of statements - do i assume that there wasn't any.

 

Also, I had statements back to 2001, the account was opened in around 1987, maybe earlier, should i expect to get some form of data from then that would now be on fiche being as the Data Protection Subject Access Request states 'for my banking history with your organisation' - should I be chasing them for the complete data? I know that there were charges prior to 2001.

 

So many questions:)

Hmmm.. just re-read the letter that came on Tuesday.

Should I be phoning Lorraine Cassidy to find out if I can expect more info and if she says 'no' - how should i respond? There is still a month before the 40 days is up (March 17th) - should I insist on the information from the beginning.?

i think i am about ready to get my prelim printed.

 

I am going for contractual interest from th beginning but could not find a template for claiming so i have taken extracts from other threads and rehashed the section that states my claim

 

Could someone please advise if this is ok?

 

What I require

I calculate that you have taken £xxxx.xx plus £x.xx which you have charged me in overdraft interest for the sum which you have taken. Total £xxxx.xx. I also claim interest at a rate of 29.65% AER as set out in the attached list of charges. I believe this rate to be justified under the principle of mutuality and reciprocity, and is based on your Unauthorised Overdraft interest rate that would be applied under the terms of the above mentioned account. Therefore the total amount owed as of today’s date is £xxxx.xxp

 

These, and any other charges you apply to this account subsequent to receipt of this letter will be added to the claim along with any interest they incur.

I enclose a schedule of the charges which I am claiming with this letter.

 

I have really been unsure of what i am doing today, I want to get it right, knowing my luck I will be the first to actually have to go to court.

 

If the above paragraph is not OK - could someone please help with the wording.

I have also drafted a letter to try and get the rest of my info prior to 6 years and need an opinion on whether it is ok

 

"" Thankyou for sending statements dated from 2001 to the present time. Firstly I would like to comment on the nature of packing for them. Royal Mail had to repack my mail in a plastic covering because of inadequate packing by your office. This is frankly, not good enough, and more care should be taken to protect a persons personal and private documents.

 

Secondly, my Subject Access Request is not complete. I draw your attention the first three paragraphs of my original letter, specifically the text highlighted in red -

 

“Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

Then theres the paragraph about manual intervention. Then there's -

 

If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.”

 

Under the Data protection Act 1998 Subject Access Request, I believe I am entitled to all information as requested. That is, from the time the account was opened which I believe to be approximately xx years ago.

 

The time limit for compliance is as stated in my original letter, the forty days elapses on the xxxxxx 2007. I respectfully ask that you comply with my request within the timescale given.

thanks - interesting thread.

 

At the moment I will only be claiming six years worth of unlawful charges with contractual interest.

 

But I do want NatWest to comply with the S.A.R. and give me ALL the info to which I believe I am legally entitled, and that means 20 years worth and not just the six I have got.

 

It will be interesting to see how they respond to my request, I will post the result on here.
