    • retailer said they'd speak to dpd on Tuesday. I don't want to screw the retailer because they were doing me a favour by fixing it for free  I hope dpd will refund them so they don't lose out. Will keep you guys posted.
    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were. Not to mention, delivery instructions are supposed to override actual customer's address which is why they asked for instructions I thought.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally. In the case of speeding offences, the police may issue you with a conditional offer of a fixed penalty of 3 points and £100.00 fine by post or an offer of a speed awareness course. If the offence is considered too serious for a speed awareness course or fixed penalty you may be charged with an offence which normally occurs by way of the issue of a Single Justice Procedure Notice. If the vehicle within which the alleged offence took place was registered to another person or company there is technically no need for a notice to be issued to the driver. After the police have obtained details of the nominated the driver, they will normally send the notice to them, although there are no time limits within which they must do so (provided that the notice was received within 14 days by the registered keeper of the vehicle). In such circumstances, a person may receive a notice several months after the alleged offence too place but still be prosecuted. A Guide to a Notice of Intended Prosecution | Motoring Offence Lawyers the above copy n paste link has purely been copy n pasted here to inform you of the regs, which you could have done yourself by, as this is, a google search......... we do not ever recommend using such offered webservices! dont dx

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, I sent the following simple email to Sharon, and she's replied as shown. Looks like I've got Paul Quinn! Maybe I'll hear from him this afternoon. Or maybe I'll try to contact him.

-----

Hello Sharon,

I've never contacted you before about this claim. It is our court day tomorrow (June 21st) and to be honest I'm surprised not to have heard anything from Barclays by now.

Do you know if Barclays intend to allow this case to go to court?

Thanks,

------------------

The reply: -

I have forwarded your email onto Paul Quinn, who is dealing with your claim.

Paul’s contact details are as follows:

Tel: 020 7116 5634

Email: [email protected]

He will be in the office within a couple of hours.

Regards,

Sharon

Hi LynZe,

Yes, but it took a little finding again! This is it. You download the zip file, extract it, then you need to customise the contents page, and there are a couple of web links that you need to go to and print direct from web. :)

Of course, you must also include your own bank statements, and copies of any communication with the bank.

Thanks cogley, I'll keep this thread up to the minute now until whatever happens happens! Good luck with yours too.

I'm just about to contact Paul Quinn directly, see if he is interested in a settlement out of court.

Hi,

I have a hearing date of 11/07. I found out yesterday that my claim was also in PQ's caseload.

I have emailed him, with a copy by snailmail too, just in case.

will let you know what happens.

I don't believe they'll want to go to court... expect you'll get a reply soon.

:D

Have you tried phoning them oneofakind? I am considering it but I am doing this on behalf of someone else so don't suppose they will speak to me.

Anyone know where I can get terms and conditions from 1994 or early paliamentary motion or this Australian report for my bundle? I will have to hand deliver it tomorrow.

Hi oneofakind, Good luck with your claim.

I haven't exactly had a reply from PQ, but I did get a reply, and it was cc'd as what appears to be an internal transfer, as included below. Note the email addresses, it appears that there are at least three people working as PQ, or maybe he just keeps multiple email accounts to organise his workload!

My message to PQ sent at 11:00 today: -

Good morning Paul,

Tomorrow (June 21st) is our court day, so I though it might be worth asking if the bank are interested in a settlement beforehand, or if they intend to go to court with this one?

Please feel free to contact me by phone, as below, or email

Three or four minutes later I got a reply of sorts, the content first: -

Hi LynZe, I think there's some assistance on here somewhere - give me a few minutes and I'll try to find a link for you. :)

However, from memory of doing mine, I should say that most of the bundle you simply have to print out. It details the past cases normally referred to as precedent for our claims. Along with them, you have to include copies of your bank statements with the charges highlighted (tiresome, but not difficult), and copies of any communication you've had with the bank concerning these charges. Also you need a summary sheet showing the charges and their total - there is a brilliant spreadsheet for this -I'll find that link for you too.

Finally you need to number the pages, and edit the contents page, then bind it into a convenient package, with your case number and account number clearly marked on the front.

Hi just thought I'd let you know I received an email from Kate Ashton to say that she has sent a settlement letter in the post. Do I take much notice of that or should I get on with this flippin bundle lark? I have asked her to fax me the letter in order we may reach a speedy conclusion. I'll let you know.

Oneofakind, I'm gonna pm you my email address right now. Thanks loads x

Hi all,

I've just got through on the phone to the Leicester court, and apparently Barclays have not complied with their requirements! :) :)

This means in effect that I have won! I have been advised to visit the court tomorrow anyway, and they will help me with the next step, but basically the defence from Barclays was either thrown out, or didn't arrive!!

Not being one to count my chickens, I'll hold back from claiming a win until I actually get the money - but its looking good!!!

cogley - see what the letter says, maybe (just maybe!) they are now seetling in full. If so, then you don't need the 'bundle'. If, on the other hand they have offered something significantly less, then go on and get your court bundle ready. It's not that bad once you get started.

Hey good for you! Having to turn up will just be a formality but I can understand you not wanting to count your chickens.

Bundle has to be at the court tomorrow so I am ploughing ahead, lost under a mountain of paperwork. I too am not counting my chickens were Kate's letter is concerned.

Let us know how you get on tomorrow x

Thanks cogley, will do.

If I can be any help at all, I'll be on line most of the evening.

In fact, you can private message if you'd like my email address. I always monitor that closely.

Ahhh im sorry they didnt respond with an emailed settlement today!! What a chore having to go to court tomorrow but remember you could be quids in!! Yay!! Keep us all up to date with the outcome. ill be thinking of you.. what time is the hearing|?

Thanks LynZe :)

The letter from the court was waiting for me when I got home this evening.

It appears that Barclays failed to file their defence! So the court has 'struck out' their case. Meaning I win my claim bt default.

The actual hearing is cancelled, but I need to attend the court for advice on how to proceed and get the money from them.

I guess they'll string it out as long as they can, but they must pay! :)

I'll continue to update this thread until I get the payment.

Thanks for that link saintly_1, very useful. I guessed maybe I'd have to apply some pressure, so that starts tomorrow.

I guess from the exact nature of the letter I got from the court today, that the same applies to several others due at Leicester tomorrow.

Well, ok. That was interesting!

Attached is an image of page 2 of the letter I got from the court, it arrived yesterday June 20th, the day before the hearing was due (today). Page 1 is just a standard cover from the court and has only my personal details on it.

Having phoned the court yesterday, unaware of the letter, I was told what had happened, and that I should go to the court anyway where I would receive advice on how to proceed.

Today, a very helpful young lady at the court gave me a sheet of paper, and asked me to write a simple letter addressed to the court requesting judgment in the appropriate case number, and for the total amount of money involved (in this case a little over £1000).

She then took it away briefly to confirm it was OK, and finally stamped it with a rubber stamp of some kind, and placed it in one of her trays.

Apparently I can send in bailiffs if I don't have the money within 14 days! :) (I think she meant 14 days from judgement, but I'm not sure)

A few minutes ago I tried to phone Paul Quinn and got an answer machine, so I left a brief message asking for the money, and to phone me back.

I have also sent a brief email requesting the money be sent by cheque immediately.

So far I have not had a response from either.
