    • I am reading the thread now and think although its probably very similar to my predicament,  I have no way of obtaining the terms anymore due to MyParcelDelivery having being dissolved and their website not being active now. I have nothing to quote from and they didn't send me a copy at the time of order, the website that I believe they reinvented themselves as P4D has terms I am looking at now but however similar they may be I wont be able to quote from them in this case.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,

 

I have just called Halifax to get my last 6 years bank charges.. They charged me £5 from my account which was took out 5 minuites after the phone call!

 

Before they agreed to send me my charges the guy I was talking to said "Oh Mrs Jones I will have a word with my superviser and see if we can get SOME of these charges refunded today!" I was astonished but kept my cool and said no I will just have my statements please hehehe..

 

Wonder how much they would have offered! :rolleyes:

 

Anyway they say I will recieve them in 7-10 days!

 

Wish me good luck peeps, will keep you posted!

Received 15 envelopes this morning from the Halifax..(Who else!! lol)

Statements going back the 5 years since we opened our account.. I have never been so happy seeking out past charges, felt good hehehe.

 

£1,684 in total.. that is gonna come in handy.. My husband is not working at the mo and I am a Student Nurse on a pityfull bursary!:(

Royal Mail says Prelim delivered on the 03rd Feb (Sat)... Will give them 14 days from today..:rolleyes: LBA due on the 19th Feb!:D

Ok.. first standard letter has been sent to me today... I am sorry to learn that you are unhappy with the charges applied to your account blah blah blah.. 4 weeks la de da de da lol...:D

Well have not heard from Halifax yet :(.. Just the standard one after I sent off the prelim! I am due to file for court on Monday, they still have a few days yet.. Has anyone called them at this stage and got their money back? and if so who did they talk to? I have had no offer, but maybe a polite reminder may kick something off?:confused:

I have seen that other people have called and got their dosh back, I am just scared that I am gonna say something I shouldn't lol.. Don't want to make a great mess of it! Just my luck that I am broke and they will just laugh at me lol...

Well just called customer relations at the Hellifax! I felt sick :|

 

No Joy they said that my claim will not be sorted out till April! :o

They said they have sent a letter out confirming that they have received my LBA but no offer.. Looks like I am off to court!

Well well well LOL...:D

 

I have just called to try and speak to Alan Molineux.. apparently our case is being dealt with by another office! They gave me a number and told me that Laura Flatroth is dealing with our case.. Called the number and asked for Laura! Not available! Spoke to a nice young man called Simon who said oh you have been offered £1,108.00 havent you...:confused: I said not as far as I am aware, he said there is a letter on it's way to you with an offer of that amount.. I said thank you very much, I will accept that as partial payment but I will be pursing you for the rest in court. He said I will have a word with laura and get her to ring you.. I said well I hope it is this afternoon as I am filing for court monday morning!

 

Now waiting for a phone call!:p

Hi, Clairem,

 

It has been 5 weeks really.. 7 days to recieve statements, 2 weeks prelim and 2 weeks LBA... LBA runs out for them today.. supposed to be filing for court monday! I know they are taking longer at the mo to sort things out, but they are looking to settle before court action.. this is my second phone call to them this week and they have left it till the last min to offer.. I did make them aware a few days ago that their time was nearly up with my claim just to make them aware!

 

And no phone call yet.. suppose that will be the last min too lol

 

No luck needed for you Clairem.. you will get your money! Just hope it is sooner than later for you X

Well it is now 19:41 and no phone call from Laura, should i give them another call before I file for court on Monday!? Yeah I think I will :cool:... One last chance to sort themselves out! The guy I spoke to was Simon Rodem (maybe his name should be Rob-em) lol..:lol:

 

To be honest he had no power to offer me anything and he was only talking to me on behalf of Laura.. Who was unavailable!
