    • Thanks in advance for advice! I was shocked to find out when doing a credit score search this weekend that I have a CCJ in my name. I've spoken to the courts today and have been told Vehicle control services have taken me to court for parking without a permit in my own allocated parking bay that came with my flat rental. The CCJ appears to be to the right apartment block but the wrong address.  It dates back to 2017. The judgement was passed in April 2021 without my knowledge of the ticket or the case ( presumably fine information was sent to the wrong address) I had already been taken to court by VCS previously for parking in my own bay and I won. It seems to me that this is underhanded behaviour from VCS as they had my address from previous interactions and had tried taken me to court for something that a judge had previously ruled on. I'm seeking advice on next steps. I was told by court that i can raise a dispute on the CCJ but I also want to appeal the case altogether. Should I be filing an  N244 Application Notice with an N161? I was told I should pay the court £303. Now that I've got home and had a look, there is a long list of court fees so I'm not sure which is applicable. I was also told the £303 is not refundable. Should I be filing a counterclaim or is that something that can be done at a later date. Ultimately I feel disgusted at having a ccj and then having to pay for the privilege of getting it removed. Any advice on how to make VCS pay for this would be appreciated!

    • As gesture of goodwill, we were eventually given a courtesy car from Mercedes (after numerous complaints from us on their lack of communication / misdiagnosis / time they’ve had the car - we’re now at over 4 weeks without our car) They have literally just informed us it will be ready to collect tomorrow. If we pay the cost, where will we stand? It’s so hard to understand what we should do 😫 we will re open our complaint with the finance company then. We emailed Doves yesterday informing them of all the problems (we have touched base with them and let them know prior to this) but they are yet to respond.    Any further advice would be greatly appreciated!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Going through paperwork came across this letter, it was sent before I raised any concerns about charges.

 

In a nut shell it says -Sorry we seem to have overcharged you 3 times @£12.5 over last 28 months, please accept this back plus 12% pa for interest.

 

My point is :- if they offered 12% pa then this could be used as a bench mark for submissions to Court.

 

Happy to send E-mail of original letter to any one who wants one for their own use.

Dear Mr xxxx 26/08/06

 

I am writing to let you know that we will shortly be crediting your account with a refund of charges.

 

We've found that , unfortunitely, some customers were incorrectly charged an unauthorised borrowing fee when their account went overdrawn or above their overdraft limit without prior agreement. As you may be aware, our policy is that we do not charge in such situations when the amount involved is £50 or less.

 

Please accept our sincere apologies for this error.

My point is not the fact that it concerns the amount overdrawn is less than £50 (although this may be of interest to many on here) but the fact that they offered 12% interest refund so this could be used by a claiment to justify a claim of interest.

 

I was thinking of ringing the chap up on Monday and thanking him for the 12% but pointing out that I had paid 29.8% on this error and would he like to refund the difference!!

 

What do you guys think about this?

Weird. Pre-emptive strike maybe? Would rather wait for the opinions of a mod on this one. I'll be waiting for the postie with a letter from LTSB offering all my money back. How kind of them.

 

Banks never give money out unless there is an ulterior motive and even then they grudge the payment.

Agreed -no such thing as free money even if it is ours anyway.

but I did recieve that letter on 25-8-06 and I first went to the bank on 29-9-06 to beat my drum. only found the letter when putting everything neat ready for my claim starting.

No you cant use any rate for interest other than 8% statutory interest, or contractual at the rate(s) stated in the contract. For Lloyds this is 29.85% and 18.2%.

Thanks for your comment, I know you cannot change S69 @ 8%, I pointed this letter out simply to highlight that LTSB have now acknowledged (in writing) that anyone deprived of funds is entitled to receive interest refunded. I am not aware of LSTB having done this to date.

I don't think that there is any gneral significance in the letter. However, if they have had the use of the money then I would certainly suggest that you go and get the balance of the interest at the unauthorised rate.

Thanks for your comments,

 

I contacted LSTB this morning as you suggested.

I reminded them that they had taken 3 payments in "error" and had offered these back with interest at 12%,

I pointed out that they had charged me 29.8% during the same period and that the difference from their 12% offer and my 29.8% calculation was £26.66.

The very nice chap phoned me back 1 hour later and agreed.

He also said as I had to chase this up he would round it up to £50 to cover my time spent on the phone !!

 

Anyhow this is not about the £26 -it is about now I will have a letter that says they agree to refunding 29% which I hope will boost my main claim from £4k to £9k when I hit them with it.

 

If a judge ever gets to see the letter, I doubt SC&M or their heirs will have much to say by way of augument!!!
