    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello All,

I am trying to submit my SA online as i have done in previous years, only this time I worked abroad specifically Netherlands in Tax year 21/22 whilst residing in the UK. I have been taxed excessively by the Dutch govt and I submitted a tax return over to them - still awaiting the outcome.

In the UK I need to also declare my foreign income and I am confused how to do this - I have read that I need form SA102 and SA106 but that's if I am doing a paper return, where or how can I access these options for Online declaration?

Any help is appreciated

Thanks

  • fro changed the title to Self Assessment - Foreign employment income

Hi FRo,

Have you tried HMRC's Tech Helpline - Telephone: 0300 200 3600

Did you "Tailor your Return" at the beginning, so the online form gives you the option to declare foreign earnings. Just checked on my SA portal and there's the option - "Help about: Tailor your return 06 - Foreign income or income gains"

We could do with some help from you

Do I still need to say I'm employed even though it's not in the UK? guess that's a yes

Main question - is this the total foreign tax I have already paid?

Foreign tax credit relief
2. If you are calculating your tax, enter the total foreign tax credit relief on your income:

Hi Fro,

If you weren't employed in the uk in the year to 5/4/22, "tailor  your return" to show you weren't employed in the UK.

Declare the gross foreign income and the foreign tax deducted  from it.

Hey Slick,

Thanks for taking the time - it doesn't really give me that option - it's employed or not employed

then this line under the help section on employment

  • were resident in the UK and received an income from any foreign employment (see attached)

So I did as you said above and expected the tax that I have paid to be offset against UK one - system calculated 17k owed, until I entered the foreign tax I have paid then I got £24

Foreign tax credit relief

2. If you are calculating your tax, enter the total foreign tax credit relief on your income: Entered my foreign tax here

I will try give them a ring tomorrow as well - 20 days to go :)

Calling HMRC is the best option. We could waste days going back and forth, me trying to get the right info and you trying to provide it.

Were you working in The Netherlands but living in the UK, maybe travelling home between working away ?

You are right, I think our posts will help someone someday, I work in IT so I did most of my work remotely (online), occasionally needed to visit the datacenter

Ok, so mostly you were in the UK working remotely for a foreign employer who paid you from The Netherlands and deducted tax at source.

As you were non-resident for Netherlands and resident for UK taxation, is there an option to reclaim tax from The Netherlands ?

Let us know what HMRC suggests.
