    • Thank you All, i apologise for the lack of paragraphs  i'm new and unsure how to use this and cannot convert my photos of the forms  to pdf's sorry so i really don't know what do, was very stressed with everthing going on without his happening. i don't know if i should just plead guilty  online because i'm going to run out of time and worried. There's loads of forms  but it's mainly three options to plead guili don't y i want to attend court, guilty i don't want to attend court, Not guilty. and then two options to plead to the speeding offence and failure to give information.     • We see quite a lot of our members receive a series of "Final Notices" . WE assume that it is to put the fear of God into you but after three or four it becomes a bit of a joke . But it is up to them if they want to waste time and money sending them out it is their prerogative. Maybe they themselves don't know what to do .  They have the choices of giving up, keep writing less and less scary letters or go to Court and become a laughing stock.  Anyone with even  half a brain would know what to do. Sadly Met doesn't seem to have anyone there who quite makes the half brain criteria.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

just wanted to say a big hello to everyone,really !

I havent felt as positivwe as I do right now since way back in 2001,which was prior to our debt problems.

in a nutshell,my OH declared himself bankrupt after being burgaled 6 times at his business premises.we couldnt get insurance cos of being burgaled the year before and the final burgarly left us down 14K in stock.so he had no choice.

i took out loan on loan,upped my o/d with NatWest and maxxed my ccs so we could stay afloat.

basically ,when he went BR ,all his debt was cleared and mine obviously wasnt.as a result i couldnt afford to pay my loans or ccs and the buggers kept on adding charges and interest.I have a DMP through CCCS at £146 pm which i pay religiously.but i got thinking when i stumbled upon the MSE site.alot of my debt which currently stands at about £70000 is down to charges.my original NatWest o/d was £3000. it now stands at about £6000 plus i also had a loan through NatWest which was originally for £10000.it now stands at about £14000. NatWest applied for a charging order and my other creditors are following suit.

i have never wanted to be in the situation i am now in,who would ? and im not trying to get away with paying what i owe.but it really makes me so angry that these huge financial institutions just keep on making the plight of people who are struggling finacially,even worse.

thankyou so so much for this wonderful site.i feel like i can take on these giants,and maybe even win.

im starting with NatWest,but im going to try mbna(who have just applied for a charging order,hearing on 5th feb)and then the rest!

There is a hell of a lot of info available on this site (about the only thing I've not found are this week's lottery numbers...Oh well:rolleyes: )

 

I suggest that you spend at least a couple of days reading the FAQs and the step by step guide. That will answer most of your questions.

It will take a little time to get your head round it, but as this is a self-help forum, it will be time well spent.

If there is something that you don't understand, then please ask. The answer won't be far away. It is easier to answer a dumb question about something you don't understand than to try and correct a big blunder once your claim is under way.

Feels great to be part of the gang !

 

I was talking to my very grown up 14 yr old daughter about what we were doing and how i'd been on the MSE and CAG sites and she likened the CAG and the MSE founders to modern day Robin Hoods - taking back from the big greedy corporations and giving back the power to fight for whats rightfully joe publics !

 

 

Quite a statement from a 14 yr old !!!!

Hi thereshope.

 

Keep us posted with your progress with a thread under the banks names.We can help answer questions quicker that way.

 

Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later.

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen. You can claim back your charges, and a few are trying for the payback of Early Redemption Charges on loans and Mortgages.

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time.

 

This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help.
