Hi

 

I have just received a letter saying that Abbey are pulling in my £850.00 overdraft and this has spurned me into taking action.

I have a feeling that I should try and obtain a written agreement to pay back this as a regular monthly amount before launching a possible Court action for £1709.00 bank charges. Now I am in the fortunate position of having six years of bank statements so I presume once I have sorted out my repayment of the overdraft then i can just write to them requesting full payment within seven days or then launch straight into Court action?

When a similar thing happened to me they pulled the plug and then a few months later issued a deault. I wonder how long they will give you to pay back the money before issuing a default.

 

If I were you I would open another account now - get all your wages and DD's transfered over. Then you can be in control. Say your wages went in on the last day of the month and you had no overdraft. Would Abbey keep the money to pay off the overdraft. I never left it to chance. As soon as I heard, all the DD's were cancelled and both my wife and me asked our employers not to pay any wages into the account.

 

Just a thought.

Stebiz' advice is very sound. You should open another account and do not entrust Abbey with any new funds if you can avoid doing so. Opening another account is an extremely good idea as Abbey will probably try to close your account after you get your money back.

 

Abbey is well known for this pulling the o/d stunt. As soon as the notice period is up they will start charging you at the unauthorised o/d interest rate. It's a nice little earner for them.

 

Have a read of the step by step guide in the FAQ. You can exclude the DPA part but you would be better to send the preliminary letter than launch straight into the Letter Before Action. Abbey will try to string matters out. I suggest that you give them 7-14 days to respond to the prelim letter and then 7 days for the LBA. Set your own timetable and don't allow them to throw you off track by trying to say it will take four weeks.
