      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im not going to say too much as i dont want my comments on here jeapordising my chances of help from getting out of this but the pep talk i can give stay strong and just never give up, half the time companies CAN do something, they just dont want to, and if you let down your defenses they will trample all over you, but if you put up a fight they will eventually sort something out. Barring '3' from taking any money out of my account helped, because then they came running to me, rather than myself stressing on hold as part of an hour long conversation probably based in India. Plus if you havent signed anything because you werent sent a contract, and they probably dont record their conversations with us, what can be done?

 

Also can i ask, why do you not hold anything against 3? commisioning this company and telling us to go somehwere else when we come for help is poor poor customer service! (and thats me being polite)

Thanks For The Chief Exececutive's Name Have Been Writing To The Address, But Have To Keep Chasing Response, Have Also Reported Too Ofcom. Three Seem To Want To Take The Money And Run. They Have A Moral Obligation, Enough Pressure They Will Have To Respond.

I ALWAYS make a point of finding out the CEO's name and bypassing customer services since I had a problem with Orange many years ago and after numerous phonecalls to their customer services team with no success I wrote to the CEO and I got my issue resolved, 3 months free line rental, a new phone and a huge bouquet of flowers!

 

Why talk to the monkeys when you can contact the organ grinder????

what a mess!

just wondering if you can help.

 

i purchased a phone obviously assuming it was 3G. but we know who?

 

anyway i have lost my phone thus need to know if you knew the insurance company the phone are insured through? can't find any paperwork.

 

furthermore i agreed to a 12 month contact 3 have told me its 18month there is 7 months left. plus 3 inform me that the phone was refurbished.

 

any suggestions.

I'm kinda confused. Did you buy this from Mobile Phone Warehouse in Wales? You 'assumed' the phone you bought was 3G.... do you mean it wasn't or didn't have this capability? (Which model did you purchase)?

 

IF your phone was covered by insurance, this yould have been supplied by the dealer, so you should have recieved a polict document. As the retailer to check, but it is not automatic that every handset sold comes with insurance.

 

3UK have not offered 12 month contracts for nearly 2 years now, so you may have understood wrongly. You documentation will confirm what you agreed to. As for the phone being refurbished, was it supplied by MPWW? This doesn;t really alter things, as refurb phones are pretty good (usually being 14 day returns) and are restored to factory-gate spec with the latest firmware, and sold on at a reduced rate/cost. All SOGA benefits apply as if the items was new.

Hi there

 

The phone was a nokia 6280.

The contact was 3G but when i recieved the call the sales person said they were from 3G NOT REPRESENTIVES OR AFFILATES OF 3G.

They called 3 times before i decided to except the offer they had all my details and stated that my contact was due to expire but i still had several months on contract left they said that they would offer me another contract and after a month cancel the one i already had.

 

All the time i thought i was talking to 3G direct.

 

I did on one occasion return the phone for repair after contacting 3G as it was function properly. They sent it back to me confirming water damage i sent it to them witha loose battery. i rang them up again on this occasion to complain. they apoligised.

 

I really confused!!!!!!!!!!!

 

The refurbished phone well 3G have stated that they normally dispatch the phone to their affilates but sometimes the supplier may have phones in stock.

But if it was a phone suppied from 3G the box would have had a sticker REFURISHED!!!!!!!!!! yes you guessed correct no sticker on box. But 3G have refurbished phone suppied on their system and cant confirm if they suppied or MPW but i was told a new contract new phone.

 

12 months or 18 months isn't a big deal either as i would have got another contract from 3G as they make good offers normally. I have been with them for the last 5 years and recommended them to friends and family.

 

I know the phone is insurance as i make a one off £60+ payment.

The bank can confirm the transaction but whom it went to they cant as it was all done over the phone.

 

If anyone knows the details of the insurance company MPW use please forward kindly.

3G = 3rd Generation Cellular, it uses a frequency of 2100MHz. Vodafone, Hutchison, O2, Orange, T-Mobile and virtual networks offer 3G.

 

Do you mean Hutchison 3UK Ltd is the network? If so, who was the dealer that sold you the phone, what was their name and where are they based? In 2006-8 Hutchison were stamoing down on rogue dealers who were calling customers offering upgrates, but the were actually new connections. When did you agree to taking on a phone?

Is this the firm based in Wales, or another with a similar trading style? Hutchison 3 have been pretty good at sorting out problems when dealers offered 'fake' upgrades.

They were hit harder than most with unscrupulous dealers who called folk and fooled them into believing they were due an 'upgrade'. When the handset arrived, is was running in parallel with the new one, on 3UK's network (whilst the original phone continued as before). Hutchison eventually agreed to assist those caught in this way, not by cancellation but be reducing the minimum term and tariff.

 

They didn't have to, as the network were the innocent party to the [problem].

Hi everyone,

 

Has anybody had any luck yet with getting their money back. I got fobbed off by Three and have since bought myself out of my contract with them (Phones 4 U supplied the money to do that and I have got a much better deal with Vodafone).

 

I am kinda on the verge of just writing my £105 off as a loss. has anyone been to Trading Standards?
