    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Started the ball rolling this morning by sending off the DPA letter for statements/charges for the last six years, I must admit I'm starting to feel a little nervous now though!

The one thing to keep me going is the fact that there must be a good couple of grand there that would come in real handy right now. Fingers crossed, Woohoo!!

 

Any words of wisdom or encouragement would be greatly appreciated.

Following my DPA letter sent 21/4/2000, I received a letter from Barclays yesterday stating how they are under no obligation to advise me of any manual interventions on my accout blah dee blah, etc, etc, etc, however they will send out a copy of statements dating back to April 2000. They have also sent back my £10 cheque as they claim this is not needed (If only they were this efficient in handing money back when facing claims).

Would I be correct in thinking that by Barclays not advising me of any manual interventions then this this could work to my advantage if this actually goes all the way to court?

 

As appropriately stated by a certain famous dance goup: WHAT WE HAVE HEAR IS A TOTAL LACK OF RESPECT FOR THE LAW.

Received my 6 years worth of statements yesterday (took from 21/4) and have had a quick look through today, it looks to be around the £2500 mark. Will do a proper count and send off the preliminary letter ASAP.

Have had some personal probs so have not been able to progress my claim till now. Have added up my charges and am looking at £2405, can someone please confirm exactly what the schedule of charges is that goes with the prelim letter? Is this the Excel spreadsheet or shall i just do a list of charges with dates? Sorry if this seems like a stupid question but my head is in the shed at the mo and i just need to try and get this done (correctly) sooner rather than later.

Any help is very much appreciated.

I am new to this site and I am looking into getting some money back from Barclays, just found out that my charges has gone up to £30 from £25 the cheeky sods. Tell me, how much did they quote you for the getting your statement for up to six years, I know it is £5 just for a few months.

I sent the general DPA request letter from templates with a £10 cheque, I then received a letter advising me that what I had requested was not a DPA request but they would send them out free charge. They returned the cheque and statements arrived about a week later.

So what is a DPA request letter and where do I obtain one? I can't wait to get started in trying to get some money back, before I didn't think it was possible.

a schedule of charges is a list of all your charges with the workings out ie:

 

 

02.10.2000 £20 Over Draft excess fee + interest at 8% at XXXp x 2009 days =

 

you do this for each charge

Finally managed yesterday to get my prelim letter sent off with a schedule of charges and it all added up to £2,340.00. I'm feeling much more confident after reading the success of some of the guys/gals on here too.
