    • I drove a friends a car for a few days and I used cuvva car insurance to insure myself for the time period. Here's the problem: I made a mistake with the dates on the insurance, I ended up driving uninsured for one day and I got a speeding ticket. My friend named me as the driver on the Notice of Intended Prosecution as she should and I will take the blame of course. Will met police ask for proof that I was in fact driving? I mean, any more other than me replying to the NIP that I will soon receive from them? Cause I assume that my insurance for the day will be the proof that they need... Secondly,  if caught driving uninsured, what will happen please? I read it's £300 and 6 points. Is that all or is it worse? I'm only asking for information from knowledgable people. If you intent to just mock, you're certainly not helping. Thanks

    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but cannot be sure. And without having an account I can't check either. But, I know that I did properly declare the item and a value that reflected its then retail price - I was concerned this declaration may have been used to single the item for theft. But now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through your huge document store of information, in addition to MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have you had render by the The Wall Coating Company (TWCC). Did you get a 20 year insurance policy for the work? Your insurance policy may be worthless.

 

I contracted with the The Wall Coating Company who (6 months and many many problems later) completed the work and sent a Guarantee certificate and an Insurance Policy Document. My insurance policy policy stated that contractor was WCC Systems Ltd.

 

The contract, work and payments are all to The Wall Coating Company, so who is WCC Systems Ltd? I have been told that The Wall Coating Company is a trading name of WCC Systems Ltd and they, but neither I, the broker and the Insurance company have any paperwork that shows that. The address and phone numbers for the Wall Coating Company are totally different to WCC Systems Ltd. I queried this with the Policy Broker and they confirmed that, because of the different names on the different paperwork, the Insurance Policy is (or could potentially be) invalid.

 

After some discussion, the broker will be sorting out he situation by amending the policy document to reflect that The Wall Coating Company is the trading name of WCC Systems Ltd.

 

So. Have you had render done by The Wall Coating Company (TWCC)? Take a close look at the part of the Insurance Policy Document which states who the Contractor is. If it says WCC Systems LTD and your guarantee certificate is by The Wall Coating Company, it may be invalid.

 

If anyone is thinking of contracting with The Wall Coating Company, be prepared for poor quality render (wonky, corners uneven, not level, not straight etc.) with the render dropped over your brand new windows and your paving slabs. Then be prepared for 6 months of trying to get the render to be put right. Eventually you may get hold of the Director Michael Richard ACKROYD who will deny any problems, accuse you of nit-picking and nagging and then threaten to send a team to remove the render from your walls.

Although it's gone rather quiet since the main operator and it all – Harvil Shaw – was banged up for about a couple of years – about a year or two ago. Maybe he's out now.

 

Have you got any idea who is it that runs TWCC? Where are they based?

 

Let me say that any lifetime guarantee which is offered by any company in respect of its work, is only as good as the lifetime of that company. The wall rendering companies which we have been hearing about on this forum typically lasted for a couple of years and then we folded and then mysteriously reemerged as something else with a similar name. In every one of these cases, the lifetime guarantee was useless.

 

We had quite a lot about some of these companies saying that their lifetime guarantees were insurance backed, but we have never come across anybody who checked up with the insurance to see if it was really in force and whether it would be really valid.

 

We tended to form the impression that there may not have been any insurance in place.

Also, I think that you might be protected by https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/300129/bis-14-693-consumer-protection-amendment-regulations-2014.pdf which I think give you a direct right of action – although I haven't looked at the regulations very carefully yet.

 

Incidentally, by making a single post in the way you have, it's pretty clear to me that you simply posted to do a hatchet job on this company without particularly looking for or expecting any help.

 

We very used to this kind of thing and it's not what we do here. If you want to discuss it and find solutions – then that's what we do

Their address is N1 Buffalo Court, Salford Quays, Manchester. If you google the address you will find other companies including, Myhouse, Alldaypa, Matrix Student Living Ltd, The Protection Hut Ltd, Transworld, Check Ltd, Ripe Design Studios, J11 Ltd, Zorin Industries Ltd, Phat Professionals, etc etc. Basically it is not a real address, just a mail drop.

 

The same goes for the phone number. It goes to a secretary who tells you (no matter how may times you ring) that "no-one is available but someone will ring you back". It is just an answering service.

 

There is zero information about it on the web except one webpage. It is not a real company (despite its name), but I am told that it is a Trading Name for WCC Systems Ltd. I soon hope to have a document that actually says that because not a single document from TWCC nor any information on the web gives you that information.

Fortunately I did. It is a real policy but it only comes into force if WCC Systems ltd goes out of business.

My main concern was to warn people their 20 year insurance may not be valid and posted a solution. ( Check your policy and if there is an issue contact your broker who can amend the details to make it valid.) If this is the wrong place, do you have a suggestion where better to go to do that?

Doubt Mr Bell will have any interest in this case however, Mr Ackroyd was a director of All Seasons Wall Systems who used to be the main contractor to Never Paint Again. That speaks volumes.

If the issue with the insurance is simply a technical matter of the incorrect name being used when in fact it is acknowledged that the company in its alternative name is covered, then there is no issue because the FCA regulations – ICOBS make it unlawful to decline a claim on the basis of merely a technical defect.

 

If on the other hand this defect really does affect the validity of the insurance, then you would be protected by the Consumer (Protection from Unfair Trading) Regulations as amended which now confers a right of direct action upon an agrieved consumer.

 

I'm fully aware of what your main concern was.
