      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have a look at the back of your latest Statement. On the left-hand side, right at the bottom is the statement:

 

"The GM Card is a trading style of HFC Bank Ltd and.............HFC Bank Ltd, Registered in England.........Registered Office: North Street, Windfield, Windsor, SL4 4TD.......".

 

Alternatively, write to the address given elsewhere on the Statement: The GM Card, PO Box 3615, Birmingham, B3 2RJ.

General Motors (or, in this case, their UK trading arm, Vauxhall Motors). Don't confuse "The GM Card" (HFC Bank) with "GMAC" (used to be General Motors Acceptance Corporation) - they're completely seperate entities.

Personally, Bicester, I would send it to their Registered Office (Windsor) as I have something of a "dislike" of companies, especially in the financial sector, that seem to have a "need to hide" behind PO Boxes.

 

The back of a GM Card Statement I quoted earlier does quite clearly refer to "GM Card" being a trading style of HFC Bank Ltd. I read this as being different from them being a subsidiary of HFC. Just my opinion though!!

Thanks a VGP Jimbo I guess that I shold probably go after HFC Bank but I posted the letters to the Box No before I read your post! Still they have gone recorded so thay cant claim they didnt get them!

I already had all my statements, never throw anything away!

So I just did my spreadsheet of charges and interest and posted the

LBA letter. I have been unable to find any other threads with GM successes. So I guess I may be the 1st!

I hope that you do not wait too long for them to supply you with

your statements, did they cash your £10 cheque! also did you send it by certificate of posting or Special delivery - ie have you [roof of posting.

As you know they have 40 days to supply you with that data otherwise they are in breach. If you read other threads from other credit cards and banks you will pick up on what has been happening elsewhere and what the next stage is.

Hi Bicester

I forgot to mention to you earlier that I did receive a reply from them on Friday, basically the usual standard rubbish and that they feel their charges were fair - they never mentioned LAWFUL. So I have written back informing them that they have to give me a full breakdown of their charges, if payment in full is not received by 4th December I will proceed with court proceedings - I have called this FINAL LETTER BEFORE ACTION.

I will let you know of the outcome in due course.

Hi seems like you and me are the only two on this site after GM so lets keep in touch! So far at 27days I have had no response to SARs so I am going to send them a reminder and check with Post Office to see if they have got them [i had two GM accounts! ]

 

I have had similar response from MBNA "..fair and reasonable etc... Keep the pressure up and good luck. stay in touch.

They have 40 days from what I gather from other threads, so 27 days is just over half way.

You can chase them if you wish! you may speed things up a little.

I am going legal with CAPITAL ONE over the weekend they are refusing to budge. I have done all I could to avoid going to Court but at the end of the day if that is what they want that is what they are going to get.
