Hi

I lived in Guernsey and now live in the UK. I entered into an IVA in 2013 and my Guernsey debt (a loan) formed part of the IVA. I've suddenly been contacted by the company to say that it isn't binding in Guernsey and they want money. Is this possible?

I'm concerned that they may try and apply for a CCJ. What is particularly upsetting is the IVA has been in place for nearly a year

From what I read, you can include a Guernsey debt in a UK IVA. You need to contact the people who dealt with the IVA and they will deal with the company that is hassling you.

Hello there,

 

This is correct, it can be included. The creditor would be given the chance to vote, if they are a large debt in proportion to the others they could prevent the IVA from going ahead (75% by volume have to say yes to the IVA).

 

Please also bear in mind that an IVA is recognised in UK law, but it may not prevent a foreign debt being enforced in other jurisdictions.
