    • I think we normally recommend people to follow the upload link
    • I removed them as they have my email address on them, and so shall repost them once my Snagit scrolling capture thing starts working (needs reinstalling I think as it keeps falling over); they are an email that runs over two pages, so would be best suited to a scrolling capture. As for multi page formats, this is harder as I have no tools available to merge documents, unless you can suggest any free ones that will perform offline merges without watermarking
    • Oh that is very helpful, thanks a million for answering my query. Looking at the license right now. At the front it says the issue date is 2022 (that's when I swapped it), but at the back it says 2015 next to Category B. So, I'm definately at 12 points, right?
    • The two PDF documents that you posted earlier are unavailable. I don't know why but maybe they are corrupt. I have deleted them Please will you post up again. Also please can you post multiple PDF documents in a single file multipage format, correct order right way round et cetera. Thank you
    • The New Drivers Act sees a driver's licence revoked if he accrues six points within two years of becoming a qualified driver. If you passed your test in an EU country, then that is the date you became a "qualified driver" for the purposes of that Act.  For drivers who became qualified more than two years previously, if they accrue twelve or more points within a three year period they face a mandatory six month disqualification unless they can persuade the court that they or others will face "exceptional hardship" if they are banned.  In both cases, the dates of the offences are used to calculate the relevant period.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi..

So I have a few payday loan debts totaling more than what I can pay back.

I foolishly, so to speak, have been robbing peter to pay paul... Peter being a lender and paul being another lender...

I want to set up a DMP but one of the loans I have taken out I have not yet made any payments towards.

Is it possible that this will be declined or not accepted due to this reason? would the creditor have reason to not enter into a payment plan? would the DMP company not try if I havent made a payment?

Thanks for any help + advice.

Hello there.

How much debt do you have in total?

It doesn't matter if you've not started making a payment on one of the loans so long as you can show that you're in financial difficulty.

Best wishes,

Seq.

Thanks for coming back to me.

Total debt including everything stands at £11,000.... debt going for a DMP would be £2000(unsecured)

Have not tried for professional advice from step change or anywhere like that as I do believe a DMP is my best bet.

I dont owe enough for anything more serious than a DMP but I owe too much for the creditors to negotiate a reasonable price with me (I have tried, set some up but just couldn't afford them)

Thx again.

Leaving office now, will check back later... thx

I am confused by just what you mean. What exactly do you mean by a DMP? Are you talking about a do it yourself plan?

Any opinion I give is from personal experience .

Hi

Just following on from others

Any chance of putting your Statement of Affairs?

A number of DMP providers have entry criteria you usually have to meet before they 'will take you on' so to speak.

If a DMP is appropriate then you may feel you can manage things yourself as more and more people are doing (depending on circumstances of course)

The CAB have a completely FREE online Debt Remedy resource and Self Administering Debt Management Plan System.

The CAB Debt management Plan system saves all your details, does all the letters, financial statements, has industry accepted expenditure guideline figures, you can return to review and update, you don't need an invite to use or amend anything, it is totally flexible, you are in charge.

The CAB system won the IMA best initiative award 2012 and is now being widely and successfully used.

An advantage of the CAB system is the recognised name of Citizens Advice as far as dealing with creditors is concerned with a significant and maybe game changing announcement now imminent.
