Please can someone help I went to the court yeasterday to hand my claim in but she said I had this statement missing I don't understand it the bit about the daily rate and also the bit about the interest up until the day you make the claim.she told me to correct it and come back tomorrow

The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 29/04/2005 to 25/10/2006 of £349.02 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of

This figure should be the 8% interest figure not your charges

 

The daily rate is just your charges x 0.00022 = £0.xxp

I took my claim to court on the 25th October haven't heard anything do you think I should call them or should I wait

 

Give them a few more days as they have to send the claim pack out and then write to inform you that it has been served. Even Moneyclaim online takes a few days to recieve notification from the court, and that uses the courts bulk mailing service.

Thanks for your help I am only claiming £437.00 what do you think they will do

 

Abbey seem to be making a habit of putting in a defence lately, so my guess is they will do that with your claim. maybe make a GOGW at some stage. So be ready to take it all the way. They will almost certainly back out sometime after the AQ stage and the actual court appearance, I hope :D

 

About to complete the AQ I recieved today and will be posting in my own thread Tamadus v Abbey later thsi evening which should be good for a laugh as I also got their defence today :lol: 2 copies in fact as one comes with the AQ.

 

After reading it I am really looking forward to the day in court as they are going to look such fools :lol:
