Please can someone help me witht he wording I need on a court form.

 

I am claiming for part known amount and part unknown amount .

 

I have sent Abbey the relevant letters I have only got some of my statements and they have used the microfiche argument to deprive me of the rest.

 

I have already complained to the ICO and have sent Abbey the LBA and now their time is well past up and I want to file my claim without further delay in the hope I get some much needed money back before Xmas.

 

I will be filing in person as I am exempt from the charges being a disabled single mum on benefits any help please with wording would be much appreciated as I dont want mess up at the last most important stage.

I think that is exactly what you need to do.

HSBC

7th October 2006 - Prelim for £3078

24th October - LBA

7th November - Claim filed

11th November - Acknowledged with intent to defend

11th December - Defence filed

16th December 2006 - Offered full amount but no default removal. Rejection letter sent.

 

Halifax

7th October 2006 - Prelim for £3427

24th October - LBA

3rd November - Offered £913

3rd November - Accepted as partial payment

7th November - Claim issued

21st November - Acknowledged with intent to defend

11th December - Offered full amount but no late payment removal

4th January - SETTLED + removed adverse credit info

 

A & L

19th October - Prelim for £540

26th October - Offered £358

2nd November - Accepted as partial payment and LBA

27th November - SETTLED + removed adverse credit info

FWIW

 

 

I don't think in practice you can claim for an unknown amount, you can estimate if you wish.

 

However, ultimately it is up to you to prove the charges and it isn't up to the bank to produce the evidence to allow you to do that.

 

What i would do is make their non-compliance part of the claim.

 

This is what i have just done with Barclaycard.

 

I will post my particulars of claim if its of any use in Glenn vs Barclaycard.
