I haven't seen this for some time , However you must first of all object to the Jurisdiction of the court and at the same time lodge brief details of defence

I will come back to you in more detail a bit later.

 

CLEARLY A NEW TACTIC FROM PARKING EYE .

 

Can you provide some detail how you obtained this charge and I wil write something up.

 

Can you scan up what you have received as I am reading into this at the moment,

I am also waiting on a call back from Nothampton County Court,

If they are sending out dummies we could complain to the OFT and the Land owners.

 

I have just received a call from NCP stating that if the defender lives in Scotland

the claim will automatically be struck out as the court does not have jurisdiction.

an simply ask what will happen to the claim if the defender lives in Scotland.

 

 

Provide the court ref from the paperwork PE have sent

and confirm that it will be struck out,

that way you will know if they have actually lodged or if they are bluffing.

 

They either require Geography lessons or they are using a scare tactic to try and extract money.

 

 

Nevertheless please scan up the documents , this way all correspondence can be compiled and complaints lodged as need be.

I think we should keep an eye on this one as I sincerely hope that that PPc's do not use or abuse the clearing system at Northampton

simpy as a means of frightening Scottish vehicle/owners into paying.

 

 

Particularly as the BPA has issued the following statement to a Scottish Local authority regarding liabilty for payment (If indeed any exists)

 

You are absolutely correct in that contract law makes it unlawful for the private parking operator to pursue the Registered Keeper of the vehicle

– it is a fundamental of contract law that a contract is formed between person A and person B (the operator and the driver)

and with a few exceptions (the law of agency being one),

person C (the keeper) has no part in the formation of that contract and so cannot be held liable.

This one is to say the least extremely interesting and please keep us updated, in the interim period

 

 

during the course of the next few weeks arrangements are now in place to target private parking companies

such as Parking Eye who may or not be using online court forms from Northampton County Court as a means of trying to enforce their highly questionable charges.

 

The plan

Over an unspecified period of time 4 Scottish registered vehicles (already arranged ) will enter premises where parking is supposedly controlled by BPA members in England or Wales .

 

1) Vehicle one will leave after a short overstay of X.

2) Vehicle two will overstay for a period of xxx.

3) Vehicle three will enter the premises, leave and return in compliance with the terms and conditions to test the accuracy of ANPR

4) Vehicle four will overstay for as long as they wish as the vehicle is registered in Scotland but driven by a none English Speaker who does not understand the small print as prescribed by the BPA.

 

All parties will ignore the begging letters and wait for the outcome.

Life has once again become interesting, it's not that long ago that I spent my time yawning through Parking Eye's Norwich Pharmacal Order letters. It just goes to show that every day's a learning day, until I read further into it I thought that an NPO was a recipe for homemade viagra.
