    • The reason I asked was that the Director said you only appealed once to  Bank and appeared to ignore that you also appealed to the IAS who gave the pointer what he think happened. Could it be that the director deliberately ignored the IAS decision and hoped you wouldn't mention it?
    • Hi BankFodder, Thanks for the reply.  I will take your advice and read through more thoroughly. To answer your question, the value of the laptop is £255.  When filling in the online form to prepare the shipment it asked what the contents of the parcel was and the value and I specified "laptop" and "£255". Thanks.
    • Before you start this claim you need to have a lot more confidence in what you're doing which means that you need to understand the way forward in the principles involved more thoroughly. We will help you and you will probably get your money back but this is a self empowerment forum and so you have to do your bit as well. Please will you spend at least the next couple of days reading through the stories on this sub- forum. Try to understand them thoroughly.     • Unsure what would be classed as appeal I first contacted the applicant then IAS. I am not aware I could appeal again as Bank state I was informed that is news to me. I would have to look through the paper work, I apologise I forget so much due to my caring duties wish I had quality time to get so much done. Will try and look tomorrow, appreciate everyone's time and input.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i have asked abbey formy money back and they say

 

"having carried out a ful investigation, i can assure you the charges do not contravene those regulations and therefore i cannot agree to refund all of themhowever as a gesture of goodwill i am prepared to cancel charges totaling £810"

 

what do you think i should do i'm claiming £850 and they offered £810

and what do they mean cancel charges toteling £810 does it mean they will pay it me back or what i don't unerstand pluss i have had more charges since sending this letter how do i go about geting them all back:-|

Dear Coolcat

 

Obviously they are offering to refund your £810.00 instead of £850 but being as this is nearly all they owe you I would take it and then take up the issue of the new charges they have made recently as a separate issue. Good luck.

id tak eit too, they didnt offer me a penny and i got the same letter as you! had to file court papers and mine is a smaller claim :confused: id probs take the cash to be honest and go for the rest later.

Just a quick sanity check before you go snatching their hand off, does that include the interest you have paid as well as the charges?

 

And do you realise you could charge them some interest too?

 

Have you paid anything out like postage, S.A.R - (Subject Access Request) fee, court fees which you might lie to get back.

 

By all means take the money, but understand what you are entitled to claim back and settle when you are comfortable with that and not before.

 

Don't let Abbey get the upper hand.
