      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been driving from the age of 16 in Australia, moved to the Uk 4 years ago. Had an international drivers license for a year and a full UK one for the last 3. Had a Churchill account until just recently when it was cancelled due to money coming out of the account on the wrong date and the RBS cancelling the direct debit without my knowledge. Have had no contact from RBS in concern to the cancelled direct debit or the funds not being withdrawn. Had no contact from Churchill to say the account was being closed, allowing me time to make the payment to stop the account being closed. Now Im just about buggered because I dont have the years on my license to get insurance elsewhere and also the issue with the account being cancelled without my knowledge. I cant seem to find anyone willing to insure me now. Really has put me in a bind as i was already limited by the fact im on a visa in the UK which seems to go against me on insurance (and everything else) - if someone can suggest a car insurance company that may insure me can you please let me know. I have made a email complaint to Churchill - havent heard anything back and not sure of the 0800 numbers - thanks

Churchill and many other Insurers will send out a letter advising of the Direct Debit failure and asking for payment to be arranged. They will then cancel the policy, if this is not done. This is not in my opinion a 'cancellation' issue that needs to be disclosed, when you are asked about whether you have ever had a policy cancelled. That question really relates to a situation of non disclosure, fraud, too many claim so a bad risk.

 

You should be able to start up a new policy elsewhere or even with Churchill without there being any issue.

 

If you call Churchill, I am sure that you can resolve.

Didnt receive that letter, either from the RBS or Churchill, because i have a visa (UKBA) my paperwork has been held for a year so I couldnt change banks (all the documents needed were being held). Otherwise I would have been out of the RBS months ago with the last set of issues of setting up a direct debit. So Spoke to Churchill and they will allow me to have another insurance policy, but I would now have to pay for the full year - even though i have had direct debit payments for 4 years with no issues. They really want to hold onto their clients, not. Really disappointed in Churchill, proved from phone calls and payments in the past if there was any issues i made sure that I was up to date with everything. Not sure now even if i want to continue a policy with them at all.

See if you can speak to a Team Leader or manager at Churchill. It is at their discretion whether to allow monthly payments or not. If it was a one off issue with RBS that the DD failed, then this may help them change their minds. Churchill are still part owned by RBS.

its not a one off issue with RBS - i know a few people who have had debits cancelled and payments made early. I even had to get another account created to fix the first account a year ago. I stated that to the guy on the phone about who owns churchill and he said yes but they arent the same. Any ideas on how to get to a manager ? each number is based on going through customer service
