Ask any questions that you have but basically you keep an eye on this, keep the correspondence and if MET ever they send a Letter Before Claim/Action.     • Hi All, Can ii get advice on this PCN received at the services near stansted airport. Picked someone up at night and went to grab coffee and snack in mc Ds, and didnt realise there was zones in this car park, it was late dark and pouring with rain so obvious u see the large 60mins parking free and dont stand around reading everything.     • If you are confident that citizens advice are going to give you the help you need, then you should stick with them. No point in trying to ride two horses at the same time.     • While I agree with getting it done by an authorised dealer in this case, for future reference a stop/start battery for one of these cars are about £120 and anyone with a £40 BMW specific scanner off of Amazon can "register" the battery.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Lilli,

good news about the extra cash from BG and you'll have to have eyes in your rear end to guard the new vac.Large bottomed ladies eh I usually get sandwiched by them at the checkout -claustrophobic. I expect Janie and Girly are busy gardening maybe I'm not sure about Richard in his last message to me he said no one was listening to him any more so he may not come back,which does not matter if he has support elsewhere.I hope it all looks great when your done decorating.I might dig a paintbrush out myself next week.

I am so relieved that you are ok Richard-don't do that again :-) Lilli was sure you'd be back,I'm a bit of a pessimist.I lost two hard drives last month never had it happen before so I'm nurse- maiding this one,it's the oldest so gently does it.I'm glad the day of the soot story gave you a laugh Janie,if you had seen my OH you would have cracked a rib,very funny -the clean up wasn't though. SG your story is interesting,you appear to have seen off more companies than the recession, a service to humanity IMO.There you go Richard tough ladies and lets all spare a thought for Mr Lilli-I dread to think what will happen to him. Lovely to see all your posts......the only way is up

remember IF you find a DCA on the doorstep you can tell them to (ahem GO AWAY) don't forget the guidelines about how those with a mental illness have to be treated,if you don't know them read up on them they give you a measure of protection.

You bet we are,hope you are not too bad today I'm having a struggle thinking straight today,OH got the PPI claim I put in knocked back.:-( It would have helped enormously.Back to the paperwork for me,I hope your day is going better.

Richard are you hanging in there ? you wanted to know how it feels when the DCA rear their head well I'll keep you posted.

Hope you are painless today.I miss making things I just haven't had time lately-never done jewellrey but I watch it on C+C occasionally.Yes banks really do use the standard 6 years regarding SAR.I will have to extract the PPI policy from HSBC to get anywhere and they will string that out as long as they need but I will ask.

Richard the RCS mentioned in #141 above should help,they help put together MALG for the industry also MIND there are many sites with the relevant info.Thanks for the PM but I think you may have a virus as you are sending multiples of the same message and taking my mailbox over the limit,better check your system...either that or you have a bad twitch:-) Richard sorry but I've had to knock your PM off- my inbox filling up again with multiples of the same message from earlier I'll restore it when the problem is resolved.

please promise me that you will ask for advice on this site if you need it,stress is a big trigger for your illness and your health comes first.If a DCA does land on your doorstep ask them to leave and shut the door.

I'm sorry you haven't always found kindness but it's something we share,I too have bawled my head off when someone has been nice to me but if you are not used to kindness it can be overwhelming.:faint:There's nowt wrong with us.

glad you are back and in great form,gee I wish you'd given the advice about the wrinkles earlier.:frown: I don't know what's happened to the others... Richard's still having a few probs with his machine by the look of it........ my posts have been a bit short as I've been wading through tons of paper from the SAR I didn't get much from it so I've advised Mr Ro to do a Reggie Perrin :lol: I should have cleared all the paper away by the end of the week and I MAY be back to normal.

I really hope the FSA sorts it for you,it's frustrating when you have to keep chasing after everything I can just about remember when life wasn't a constant round of letter writing etc.etc.etc.I think I'll be kicking up the daisies by the time my OH is sorted.

Hi girls,

I never worried about insomnia like you I made it work for me, now I fall asleep at the drop of a hat and I do not feel normal at all really lethargic. Take it easy starblackie keep at the jewellrey making it's therapeutic enjoy the knitting SG1 it's in a good cause,Lilli snuggled up with the cats what a great picture that conjures up.Hope you are ok Richard I hope the messages from these lovely ladies are helping you to think positive. I'm having a day off today :-D big letter from DCA to deal with tomorrow :-( but as Scarlet said tomorrow is another day. Be cosy it's that time of the year my fire is blazing away the leaves are falling it's a good day.

Hi all,

DCA prove it letter done :clap2: it's raining heavy here so no garden today cats all in snoozing. I cleared my craft table of all the bothersome bank stuff and I'm going to make some Christmas cards over the weekend. Look forward to seeing the knitting SG1 and good luck with the meal.Thanks for the crossed fingers etc Starblackie you can relax now :whoo:tis done. I hope the tenderness fades before your visit to the vet with the cat,I don't envy you one bit. Richard you need a hobby or something that you can do in the early hours,nothing too taxing but something to distract you from the pain and worry it will help more than you think,keeping a journal maybe ? Lilli thinking about you hope it's going ok with you today . I'm off to go through my crafting stash and clutter the table up again :grouphug:

Haven't done any parchment craft in a while, got the stuff but my dining table has a partially dismantled knitting machine on it at the moment.
Mine are in the loft :| done some of the embossing today it's a biggish piece the hands behaved,take it easy and have a great weekend.Congrats on your anniversary bet it feels good.Hope you dodged the chillis.
