      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi again,

 

I have received the SAR documents today and need to no where to go next.

I signed the agreement on the 14/10/03

however monument have only provided me with the last 6 years of payment information, notes, etc.

 

I definitely had the payment break plan but I can't work out how much I have paid because I only have payment information from the 14/7/06 to the 14/5/07 when the account was sold on.

 

I have spoken to a member of the customer relations team who stated that to claim for miss sold ppi

i have to make a claim in writing which obviously I was aware of.

Is there a 6 year limit on ppi or would I be able to claim it all back?

 

 

avg out all the PBP you have and use that figure in the spreadsheet for the months you do not have staetments for

till the month you do start tohae data.

 

the FOS are quite happy for claimants to gestimate.

Hi again,

Now on to the charges and it is a bit confusing,

it states in my notes that on the 6/7/2007 my account was sold to arrow global with a balance of £1148.37,

 

however monument applied the following credits to my account.

 

£28.93 purchase fin chg credit

£141.47 cash finance chg credit

£27.18 purchase fin chg credit

£13.10 purchase fin chg credit

£10.77 purchase fin chg credit

£273.63 late fee credit

£154.64 overlimit fee credit

Total £649.72

 

The documentation now states that my account balance is £498.65

surely if they have sold the account my balance with monument should be 0.

 

Sorry for the long post and if someone could help me pick the bones out of that

and tell me how to proceed it would be greatly appreciated.

That's the thing though the charges look like they have been refunded however I don't understand how that works because monument sold the debt to arrow global who are still asking me for the region £1100. So if my charges were refunded then it means that the amount should be a lot less than the £1100

 

have you statements from the time of the sale till today?

 

could arrow still be carging int?

Hi dx, Yes I do have statements from the time of sale and it appears that they are not charging intrest as the balance has just remained at £498.65. Could you point me in the direction of the letters, etc that I need to claim back the PBP.

well not a such.

 

the charges are in a way only 'notional' anyhow.

 

even if you had reclaimed them, they would come off the balance anyhow

so thus you cant be paid for charges that you haven't paid [as they are in the outstanding balance]

Hi dx finally an update,

 

monument have written to me saying that they will refund me the ppi charges for the last 6 years which they have as £67.67 + compound interest at a rate of 22.48%

which they state is £3.87.

 

As I stated earlier the account was opened in 2003

and using the average of the amounts I have it should be £378.43 plus the interest.

 

So the question is where do I go from here?

you write back and politely pointout that PPI reclaims are not limited to the statute of limitations act.
