    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, being new to this forum I will please ask for your help fighting against the eviction notice that I've got it today (3rd of May).

Basically the story is like this:

I live in a shared house and untill December 2011 we were paying the rent to the "owner/landlord" that used to come every week to collect the rent, our only responsability was to pay for the gas only.

So from January 2012 till March his "brother" came for the rent and since the begining of April nobody came for the rent but we've receive a Hearing Letter on the 10th of April with the hearing date for the 11th of April (we went there even if our names weren't on the letter ). I went there with other tenants but we didn't got the chance to say nothing but the person dealing with the Housing Issues told us to sort it out with Goldsmith Solicitor or with the Mortgage Company.

On the 19th of April we've got this letter stating :

- the defendants give the claimant possession of HOUSE ADDRESS on or before 25th April 2012

- the defendants pay the claimant £7,000.00 for rent arrears and £32.88 per day from 3rd May 2012 until possession of the property is given to the caimants

- the defendants pay the claimants costs of £301.75

- the defendants pay the total amount of £7,301.75 to the claimants.

After this I went to CAB and they advise me to go to a solicitor which I've done and he said that I should wait for an eviction notice and that we'll continue from there (he said that the letter will take between 2 weeks to 6 months ) so we were calculating roughfly 3 months for the whole process but we receive the EVICTION LETTER on 3rd May having the eviction date on 21st May.

So we said that we need to act and find out what's going on with this house because for the last year and a half we've been paying the rent on time and now this situation came.

I started to went through old letters to find out what needs to be paid and to who and discovered a letter from the Andrews Property Services which states that the rent arreas is at £3000.00 and that the monthly payment through mortgage were £850 and they've raised it somehow to £1000.00 a month.

In short lines this is the whole story and now we (as tenants) are trying to sort the things out if we can.

Let me add more information:

-none of the persons that are state on the possession/ mortgage letters live in the house or have lived in the house as far as I'm aware of and none of the other tenants new them.

-there is a 7 years old girl that lives in the house along with her family

 

Do we need to rush to complete the N244 for or shall we try to send some letters to the mortgage company to try and spread the arrears and lower the monthly rent?

We have chat with the the mortage company over the phone and they said that they want to sell the house and they aren't looking for any payment sorting no matter what's the situation.

Hopefully I pointed everything or what I know at this moment from the letters and phonecalls.

Can you please let us know which steps shall we take and if there is any chance with N244 if we go to court because we'd rather spent the time left looking for accomodation .

Sounds like the person you rented the property from was sub-letting it to you.

 

Can you clarify?

 

Was your Landlord the 'claimant' on the court paperwork, or was he/she named as the 'defendant'? Have your names (the current tenants) appeared on any of the court documentation?

Hello Lea and thanks for replying.

 

So I went again to the only pappers you managed to find and I can tell you this:

 

"Name 1" and "Name 2" were appointed as Joint Law of Property Act 1925 Receivers the Property by Capital Home Loans Limited by way of Deed of Appointment dated 28th July 2010.

 

Then on another page there is another "Company 1" which appears as a borrower and later on the papers is the landlord.

There is this Tenancy Agreement between "Company 1" as the Landlord and then "Name 3" and "Name 4" as the Tenant where is stated that ther rent is £850 a month and il increase later on to £1000 a month.

On the Housing Act 1988 Section 13(2) at the Landlord section appears this:

"Company 1" acting by "Name 1" and "Name 2", Joint LPA Receivers

On the Housing Act 1988, Notice Seeking Possession of a Property Let on an Assured Tenancy or an Assured Agricultural Occupancy on the tenants name appears "Name 3" and "Name 4" and as a landlord appears "Name 1" and "Name 2" and the total arrears amount is £2.700.

 

Now back on the main page of Possesion Claim and hearing papers I have this:

Claimant: "Name 2"

Defendant: "Name 3" and "Name 4"

----

So you paid the rent to "Name 3" till it dissappeared and none of the name lived in the house since I've moved there.

None of the current tenant names appears on any of the court paper no matter how old or new is it apart from the notice of eviction which is addressed to "Name 4" and "ALL OTHER OCCUPIERS"

 

Becaus is Bank Holiday can't go on Monday to any solicitor but on Tuesday that'll be the first thing.

I can scan all the pappers I have and upload them in a single file if someone wants to go go through them and like this will be easier to help us if possible.

Let me know what I need to ask when at the solicitor or what steps shall we folllow.

Sorry if I go too deep into things but it's just me.

 

Was your Landlord the 'claimant' on the court paperwork?

A: No it wasn't

 

Was he/she named as the 'defendant'?

A: Yes it was.

 

Have your names (the current tenants) appeared on any of the court documentation?

A: None of the names of the actual tenants appears of any of the court letter.

 

Hopefully this will clarify the things any more details let me know and I will try to provide them if I'll be able.

You stated that you had been in contact with the mortgagee - did you write to them or speak to them on the phone?

 

If you wish to stay in the property for a period of time (maximum 2 months), you will need to write to the mortgagee and make a formal request under the Mortgage Repossession (Protection for Tenants) Act 2010.

 

The Judge ought to have allowed you to speak at the repossession hearing, as the above Act specifically makes provision for that. Nonetheless, you will need to write to the mortgagee - they ought to respond to you quite rapidly, but inform them that they have 7 days from the date they receive the letter - send it recorded delivery. If they do not respond, then you will have to put a stay application in to the court (form N244), and explain clearly that you are the tenants, that you have made a request under the above Act to the mortgagee and it was ignored/denied, and that you respectfully request that the court allow you to stay a further two months so that you can find somewhere else to live.

 

This is the absolute best that you can hope for. You cannot expect to stay in the property longer than that. Possession has been granted, your tenancy agreement was invalid (the person who gave it to you had no title to the property). Any stay that is given to the eviction is likely to be on condition that you pay the rent directly over to the mortgagee.

Been on the phone with them only (2 times) and they were saying that the goal is to sell the house and not to let us stay there anymore.

I will send the letter first thing in the morning on Tuesday like you advise me.

No I suppose there is no point of me going to the solicitor on Tuesday after you've told me this.

If the solicitor is free (the usual free 30 mins), then by all means pay a visit, if you have to pay, then I wouldn't bother. They are not going to be able to assist you in staying in the property much longer than two months, and it seems like the mortgagee feels they have already given sufficient time in any case, which may mean they oppose any stay application that you make.

 

Presumably if none of you have paid your rent since April, you will have that money to enable you to find somewhere else to live.

Hello, let me inform you how the things are up till today.

 

I finally sorted my hearing and it will take place on thursday 17th of May.

My hearing will be based on the fact that:

- all the tenants paid the rent (minus 1 month) and none of us was aware of what's going on till we went on all the papers

- there is 1 child staying in the house (8 yrs old) and the moving will messs up with the school

- half of the house is studying and the courses are due to be done in at least one month(not the best option to move right now when everyone is preparing the exams)

I think this is all but if any of you has any advice on how to present at the hearing or what exactly I need to do then I would be gratefull.

 

Took me this long to set the hearing because I was running around from one solicitior to another (from one area to another) because they heavy different days when they are free but I found out that just in some regions they deal with housing problems and when I bumped into the good ones they were not helpfull at all (they tried to send me to the first solicitors that I've went because they were saying that those are the good one which wasn't because I was already at them and so on they were playing ping pong with me)

 

Right after I put the papers for the hearing the mortgage company called me and this time they were really helpfull, they were saying that the problem is that none of us (tenants) it's on defendant name (or the 'landlord') but they gave me a bit of a hope.

Everything is on thursday morning now.
