    • I don't think they even deserve a reply...    We do have a solid case don't we?? Even though mum corgot the pop that time??
    • To start, my address both on my logbook and with the DVLA are correct.  The first I knew of the bus lane fine was when a woman on another floor in my building posted a photo of a letter addressed to me but with her address on it, on the building's facebook group. I obviously recognised my name so contacted her. She said she'd been receiving these letters for me for months but only asked in the group if anyone knew me when the bailiffs were at her door.  I contacted the debt collection agency and Manchester Council and was told to appeal. So I did and explained what happened said I was more than willing to pay the original fine but its now at over £400 and I would have paid straight away if the letters had gone to the correct address. Months have passed and I have just been told (with no reason) that my appeal was unsuccessful and I need to pay the full amount.  Any help would be appreciated! It just seems so unfair!
    • Exactly right Bank!  I had an email this morning from HM Courts and Tribunals Service Civil Money Claims: Dear Mr xxxx Claim number: 527MCxxx Parcel2Go.com has been given an extra 14 days to respond to your claim. They need to respond to your claim before 4pm on 4 June 2024.  Anyone would think you've been through this before!
    • OK, understood. The second decision to make, given PE are wobbling, would be whether to reply to them (well after 8 May to show you're not scared of them), ridicule their offer which is no offer at all, and ask them to make a serious attempt to settle.  You never know, they might offer a few quid as an out-of.court settlement and it might save your mum having to do court. Just an idea.  Something to consider.
    • If we are sure we have a valid case, she's ready to go to court. Her sister is going with to help with her hearing difficulties,  so we might as well see it through!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everybody thankyou for reading.

 

I am currently with a hire purchase company called 'perfect homes'. I have been with them for approx 3 years and never had any problems until recently separating from my husband and my finacial difficulty began.

 

I am now a single mother of 3 and also expecting again so as you can imagine things are very difficult at the minute for me. I have explained my problems to the staff at 'perfect homes' and also spoken with the manager but they are refusing to help me and instead keep demanding money from me.

Currently my weekly payments are £30, I asked if I could change this to £15 a week but they refused to help me and instead they persist in calling me upto 7 times a day, txt me, and come to my address. Recently they have started being vicious and off hand when visiting my home by heavily banging on my doors and windows, and most recently shouting obsenities and threats through my letterbox, threatening to take the washer back off me. I am starting to feel as if i am being bullied and harrassed, and as you can imagine this is very distrssing for me in my situation.

 

Upto now i habe paid them £546 for a washing machine priced at £440.

 

Please help, what can i do??

I would suggest you write a formal complaint to Perfect Homes

If at all possible, record all their drivel when they call or visit. Any little thing like that will go towards getting their licence revoked.

 

More experienced people will (hopefully) pop along and help you with the negotiations regarding the lowering of payments but you can rest assured, they CAN NOT enter your home to reposses anything without it going to court first.

Did any of your neighbours see/hear this intimidation. If so ask if they will do a statement

Yes I have someone who will do me a statement. They're telling me because its hire to buy purchase they can remove the goods. I intend to write a letter of complaint and also request a copy of my contract and each payment. Thank you for your reply.

I assume you mean Perfect Homes and not your neighbour :lol:

 

That statement is total bovine excrement. Even if they were allowed to reclaim the goods, how would they do so as the goods are in your home and if they entered without your permission, that is trespass. If they do turn up again, give them 30 seconds to get off your property or you will call the police.

The guy who came on sat was really arrogant. He was shouting through my letterbox that he didn't care and that he would keep calling back. He txt me today sayin the company can call me as many times as they like until I answer

I will do thank you. I'm scared of opening the door. Like I said I'm pregnant and have 3 children, the same man went to someone I know and as she went to close the door he put his foot in the way and demanded the goods.

these 'people' prey on your lack of knowledge and civil law. Not even a bailiff is allowed to 'foot the door'. If anyone tries this, call the cops.

You are also allowed to use 'reasonable force' if they refuse to remove themselves.

 

Contact Perfect Homes and mention a neighbour is prepared to swear to what he/she heard or saw and see what they come back with.

Hi,

had similar promblem with these people, keep ringing and calling round the house, then today had some real bully boy who said he was going to get into the house to remove the goods when i was at work and the wife was in, so he got told to go away in no uncertain terms and then i called the police for advice who where very helpful and told my wife that they cannot enter the house at any time what so ever and if they tried or threated to, then call 999 as this would be classed as breaking and entering, tell them to go away and if not you will call the police, hope this helps ;)

They're all on some sort of power trip. I will call the police next time. I went mad at one of them and told him it was harassment, he said it wasn't but since he's not contacted me much. I have written a letter to head office about it all.

iv had loads of problems with harasmen for late payments iv been very ill for a wile now fighting cancer iv had goods for over 12 months at the moment they say im seven weeks behind but im five weeks behind beacuse

the terms state if u have house insurance u dont have to pay theres they refused to accept my insurance

also i tried to get the cover pluss removed witch is optional they say has to be done in writing this i did and it was delivered by hand witch they say they have not had i do not answere phone calls from them i have sent emails stating i will only corospond by mail so i have everything they say in black and white i have now sent an email to there head office stating in there terms and con if u miss so many weeks then cover pluss is cancelled iv told them when this happens i will arrange to catch up on my payments if this is the only way to get it removed beacuse it will half my payment as one item only has a few months to go and one has about 10 months to go iv paid way over half

i have had harresment at the door in the past and i have phone and spoken to the police veacuse even after i told them to move from my door they sat outside for 45 mins and kept comming back and bannging on the door several times but i rang the police on the landline and they did not turn up in time before they left as i didnt know if i should have rang 999 when i rang back to tell the police they had gone so they did not have a wasted trip a very nice officer told me next time to ring 999 as it is urgent and they will come straight away i did it cos there atitude was ring the police i dont care so i did
