    • Please go back and read my message posted at 10:27 this morning @jk2054. I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Well, I have made it to the end....or at least I thought I had.

 

Last month i paid, what I believed, to be my final (UN) Welcome payment for my car. I then start getting phonecalls last Friday, both on my mobile, and at work, 4 times a day from my local branch stating that I still owe £190.

 

I am really, really confused by this, as I was certain it had all been paid.

 

I did the worst thing I could do, and answered one of the calls yesterday, to be told that if I don't make this payment before the end of this week, collections procedure will start, and that the car is "still thiers". Now, I know this to be balls, and it is highly unlikely that they will do anything for £190, but there is this small part of me that is terrified they will try something stupid.

 

Can anyone help me?

Have sent SAR & CCA requests today (seperatly) via special delivery. I have also sent copies of these to the local branch (as FYI only), with copies of previous letters reminding them that I have asked to be contacted by letter / in writing ONLY, and that they do not have permission to phone me or come to my house.

 

I have so far had 5 missed calls today from my local branch....

If they continue to call you around the middle of next week send them the telephone harrasment letter from the link below. Make sure you send it to their head office. Don't deal with the local branch they are not interested in helping you - they ony exist to collect and are paid on results.

Hi there I have just read your account on Welcome finance and wondered how you have got on as I have now only 2 payments to make and the 48 months of paying for my car will be at an end, but I have now had a phone call from them to say that I will have another settlement payment to pay after this before the car is mine! Can anyone comment.

Did they say how much this final payment is and how they come to this conclusion?

 

If you look at your agreement there is sometimes a fee - sometimes called an option to purchase fee - or similar - that you pay at the end of an agreement. But you need to check the agreement - If this fee has been added to the initial loan amount then it may well be that it forms part of your monthly repayments - and you will have paid it.

 

You can ask them for the statement of price which will give you a breakdown of what your monthly payments go towards.

 

Did you ever have PPI with Welcome? if so they now owe you.

Thank you for your reply, yes there is an option to purchase fee on the agreement of £1.00, now Welcome are saying it is £100, when I phoned them they also told me they were not sure how much this will actually be until after I have made the final payment next month?????

Regards to the PPI, yes this was also taken out at the time but have been told that I would'nt be entitled to anything back as they paid me £560.02 ( 2 payments) the other year after I had an operation, so looks like I'm not due anything

If the payment has been missold then you should entited to a full refund, less any amounts already paid to you, i believe. Claim it anyway. Your claim will go therough the fscs as welcome are in default of their ppi repayments - so it is worth a go.

 

If your agreement says that the final purchase fee is a £1, then it is a £1 - thats what is on the agreement - signed and agreed by both parties. never listen to the muppets at the local office - they are just collection monkeys. And never speak to them on the phone - ask them to put their claim in writing pointing out the exact section of your agreement that supports their position.
