    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, back in Janurary I opened a paypal account. I noticed for some reason that very small amounts appeared to go through when I didnt have any money in the account. I did some test auctions and bidded on stuff that was about £6000 to see if that went through, then I cancelled the transaction. What I didn't know was that the reason the payments were going through is becuase paypal was placing them as direct debits on my account (something they said they never do), so when they tried to clear, I got stung. £400 in charges and 6months of ignoring default notices later, I find that it has gone on my credit rating ( I negotiated to pay £200 back to Santander, I said their fraud dept. should have called me to ask why a brand new account had over £6k of DD's earmarked. They agreed and we settled on paying back half, seeing as no one lost any money) anyway, I phoned paypal and they said because I used a fake name on the paypal account, they wont speak to me under the data protection act (so nice of them to protect the data of the ficticious(!)) I used my real address and card info, but just a different name on the account. Now they don't want to know. What do I do now? I rang santa back up, but the lady transferred my call to an office that was closed. I want to know how to get this taken off my credit file. I want a new car! For gods sake I am 19 years old. I get screwed over by 2 jerk companies and now I can't borrow anything!:mad2::mad2::mad2::mad2::mad2:

Paypal doesnt pay by Direct Debit BUT it there isnt enough money in your Paypal account then it will either take money from your bank account that you linked to your PP account (which you clearly did) OR will take money from a debit card linked to your account (and in turn that card will be linked to a bank account), either way the money will be taken from your account (or they will attempt to), if there isnt enough money in your bank then you will be charged a fee. This info is displayed quite clearly when you purchase something, if you wish to change anything, for example to use card instead of bank account you have the option to click change and you can then do it.

 

It doesnt sound as if Paypal or your bank did anything wrong, in fact, you have admitted to using a fake name, which may well be classed as fraud.

 

The paypal T & C's (you did read them, right ?), do say that they will place info. on your credit report. as will the bank T & C's. Who has placed the info. on your credit report ?

I was only using a fake name as the name on the account, it wasn't fraud. All the other details were correct, I just didnt want people finding my name out through paypal. Paypal did place it as a direct debit. Thats why I got chargebacks, I have no idea why it went as a dd, as I have used paypal for years, and if I didn't have the moeny for something, it wouldn't go through. But this time it tried to go through, I cancelled them (obviously) but it still sat on my bank account as direct debits.

Sounds like fraud to me. Im sure the T&C's require you to use your real name. Direct Debits are something you set up to pay somone on regular intervals, are you sure it wasnt a direct bank transfer or debit card transaction (these are different from direct debit but still allow the money to be taken directly ferom your account and if not enough in there you will be charged a fee (not a chargeback, thats something different).)

Maybe the T&C's do require it, but when does anybody read 62 pages of legal jargon? I never actually paid for anything or recieved anything through that account anyway. I doubt paypal would care, they have about as much legal power as my non existant dog. But it definately went through as direct debits. I have no idea why, but it did.

Reading your inital post again..

 

Is it right to say you agreed to purchase a number of items via eBay with a value totalling £6,000 to test your account (an account opened in a fake name) and that you never had any intention whatsoever to pay for those items ?

 

If you wanted to "test" your account, why not purchase one or two items for 99p.

 

As you used a fake name, how is Paypal supposed to identify you as the person that opened the account, as you would not be able to provide any identification in the fake name.

 

What about the people that you agreed to purchase £6,000 worth of goods from....
