    • The letter is standard.  Next you will receive a Directions Questionnaire from the court. As scribbled before, we know Countrywide well.  They are a very small cowboy company with we think just two people working together.  They know nothing about the law but are convinced of their own importance and that they are right.  This means two things. 1.  They are highly likely to pursue this all the way to a court hearing, because in their minds they are sure they will win. 2.  They are exactly the sort of "arrogant idiot" you want as an opponent in court.  Simply thinking you're an important person who will automatically win is a recipe for disaster in court.  So far their win rate against Caggers is exactly 0%. So time to start building up a case against them. 1.  Are the photos of the vehicle really as bad as what you have uploaded, taken in the pitch black? 2.  How long exactly was the vehicle in the car park? 3.  Is this place local to you?  If so it would be a good idea to go back there just before dusk and take photos of the signs both in daylight and at night.  They are bound to be confusing and designed to entrap motorists, as this is their M.O.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,:)

A while ago I had some out standing council tax that was passed on to Equita. I've paid the full amount now (which seemed to take forever) and I was wondering if I can still claim back the charges that were added. I do not have any paper work left. Well may have the Ref Numbers some where.

Where would I start with this??

just an up date on this. I rang equita to find out Ref No's. A nice lady:wink: there helped me out. I also asked her if she could send me any form of statements. She said I would have to go online and send an email which I did. This was the response

"Thankyou for your email.

 

I have arranged for statements of your accounts to be sent out tonight.

 

Kind regards

Jane SXXXX."

 

They arrived a few days later, but some thing just did not add up. :confused: I know I was paying them every month for a while, but the statements she had sent me seemed a little hit and miss. So already having all the statements for the last 4 years from the Halifax (he he) went through them with a fine tooth comb and guess what? yep you've got it I've made around £600.00 more in payments than are showing on the statements form equita.

Now in email contact with them. Just sent copies of my statements.

Lets see what happens.

Received an email today from Equita, "Oh the missing payments are for another account you had with us, I'm looking into it , and will send out the statements today." (or dose that mean they will make some up?)

So not being the most trusting of people I rang the council, and asked if they could please send me statements of payments made to them. Also when I defaulted and it was sent to Equita what the balance was.

equita has been harrassing me for £535 or thereabouts for parking fine from the council.

i followed the advice on here, + got a letter from them, today, saying they have returned it to the council.

what happens now please? i will be grateful for any info.

I would stick to the advice on here, Not sure what else to tell you. As mine is council tax not parking fines.

Ok the statements arrived yesterday, showing some of the payments I made but some are still missing. So I will be looking in to that, also at the top it states

Bailiff Fee £ 50.00

Enforcement Fee £70.00

Card Fee £25.79

Can anyone tell me what the Enforcement Fee might be? A bailiff as never entered the house, and I am sure most of my dealings with them were via post. i.e. They sent a letter so I rang and made an arrangement.

Just a quick update, sent an e-mail to Equita asking if they could give me a break down of the bailiffs fees and asking what the enforcement fee was for.

All I got back was:

Sorry for the delay in reply to your recent emails. All our fees are calculated as per The council tax (Administration and Enforcement) (Amendment) (No.2) (England) Regulations 2003 act. The details of these can be obtained from your local library or via the internet.

Received another email from equita with a break down of cost. They have charged me for a levy which I understand can only be made when a bailiff as made peaceful entry to the property. As no bailiff as ever entered my property don't see how I can be charged for this.
