    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • DX, worth mentioning? I take it that you refer to after ,65 loan is written off clause. I thought that after the problems I had at deferment (/no proof of income satisfied them, and I could not afford an accountant) after they stopped pestering that they had decided that the age related clause  had kicked in. As I said, its time to hit back with SB letter.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Cabot have recently contacted me about an Egg loan. I have requested a copy of the CCA. They have sent me a number of letters stating that they are still requesting a copy of the credit agreement from Egg. I originally requested the information in Aug. They have also sent me a copy of the £1 postal order that I sent with the request saying that they don't require the payment. (Is this normal?)

 

The latest letter (dated Oct) said that following: Unfortunately Cabot has not been able to provide you with the requested information within the relevant time period. We shall continue to request the information from the original lender to assist you with your request. In the meantime, we would like to inform you that your account shall remain on hold with the Customer Assurance Department until such time we can comply with your request. Please note, you are still obliged to repay the outstanding balance as confirmed in this letter and therefore we would recommend you contact us as soon as possible to set up a repayment arrangement or continue with your existing payment plan.

 

Please can you advise on the best way forward? If they cannot produce the credit agreement can they take action if I don't respond? On the other hand, I want to get this removed from my credit file but I can no where near afford to pay the full outstanding balance. Am I in my rights to ask them to close the account if they cannot produce the credit agreement or would it be better to offer them some money as a final settlement ? I am struggling with money at the moment and I'm likely to lose my job in the next few weeks so I don't have much to give them but I want to get this sorted once and for all.

wait for CCA, but look around forum as to what steps to take next if a CCA turns up, I wouldn't contact them again just make sure the postal order isnt used towards debt

Hi jxp i have had a run in with cabot and know what they are like, without the original agreement,t&c statements ect a dont think they can take you to court. DO NOT OFFER THEM A PENNY have they sent you any paper work at all ? if they want to hold on to the account thats fine cause without proof they cant move . When was the last payment made ? I am sure other CAG members will be along shortley dont worry with the help of CAG we shall over come :) GH

If Cabot own the debt then send them Account in Dispute letter and ask them on what basis do they consider I should be paying money to them when they cannot produce an agreement which covers the alleged debt.

 

You need only pay each month what you can Honestly afford and not the amount they demand.

 

Sending the £1 PO back often happens it is their misconceived idea that they are being nice,friendly etc

 

If you close the account it will not get the debt removed from your credit file.

 

Have you checked your Credit file if so who lodged the Default?

Hi All

 

Thanks for your quick response. They haven't produced any paperwork as yet. The loan was taken out about 5 years ago and I think I applied for it online so I can't actually remember signing an agreement. The last payment was made years ago. I think it shows up a default by Provincial Bank on my credit file. Would you recommend that the first step is for them to prove that they own the debt? Thanks again.

Provincial Bank is American or the Provincial Bank of Ireland is Belfast based, cannot see the link with Egg.

 

Cabot are big debt purchasers so follow through and send the account in Dispute letter.

 

Have you received a Letter of Assignment from Cabot stating they own the debt or did Egg send a letter stating they have sold the debt to ??

Maybe it says Prudential Bank. I can't remember I will check again. I havn't received anything from Egg to say that they have sold the debt and I have not received a letter of assignment from Cabot stating that they own it.

 

Should I request this before sending the account in dispute letter or just send it anyway?
