I was wondering if I could get some advice.

 

My partner bought a car on a HPA 2 years in September. He has since given the car back.

 

Yet Blackhorse have sent a letter stating an outstanding balance of 6822.23.

 

Is there anything we can do as he is currently out of work that is the reason we we're unable to make the payments.

First check the terms and conditions

for handing the car back, it will be

difficult advise without this information.

he's asked for the terms twice now and each time they give the 1st page and the 3rd page.....but never the 2nd

states key financial info

and has a signaturelink3.gif on it

it also states

Termination Rights:

" you have a right to end this agreement. To do so, you should write to the person you make your payments to We will then be entitled to the return of the goods and to ---- the total amount payable under this agreement. that is £X,XXX.XX. If you have already paid at least this amount plus any overdue installments and have taken reasonable care of the goods, you will not have to pay any more.

 

if he's already made that payment- or up to that payment and is up to date with any installments - he can rid himself of the HP....

Also it there an explanation

for the amount they are attempting

to collect,was the car damaged/defective??

I'll write to them and try and get pages 1 and 2

also they haven't as of yet mentioned the state of the car- the balance above is the amount in missed payments.

I'll try and scan the letter I got in a couple of mins.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Ah, has judgement actually been

made if so the court order replaces

all other conditions.

If a judgement has been made what

is the actual court order, if not have

you been served with a claim pack???

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

have you actually been to court yet??

If not when is the hearing?

If you have had a judgment

then what was the order made.:???:

The court would have made an

order as to how the claim was to

be paid eg., forthwith, within 1 month

in total, or by installments if agreed.

Is there any paperwork to show this?

the car was handed back?

  • 4 weeks later...

from what I recall my partner was summoned by the courts and he went. The only thing that was discussed was the return of the vehicle there was no mention of the outstanding debt.

There was blackhorse rep.
