    • Would this be OK to send or is it too much detail already ?   "In response to your letter dated  xxx Intention of Prosecution reference xxxxxx I would like to advise that no collision / accident took place at the given date / time / location. There was however an altercation with the driver of a commercial vehicle who punched and kicked my car, verbally abused me when I stopped and acted in a distinctive threatening and aggressive manner. I advised I would be reporting him to his company for threatening behaviour and vandalism for punching and kicking my car whilst driving past in the road. When I tried to take a photo of his number plate, he came towards me in a further aggressive and threatening manner, so I decided to retreat into my car and lock the doors before he could reach me, as I was frightened he may assault me. I drove off and when I checked my phone later , the photo was regrettably unusable, as the camera couldn’t focus properly when I rushed back to my car. So I decided not to report him for his threatening behaviour and actions, as at the time I believed he would be untraceable anyway. So I am not sure if the accusations against me are in relation to this altercation, but no actual collision took place at this time , date and location as alleged in your letter"  
    • They have been sending messageslike " Do you want a refund or not"  which ive said im at work just try and avoid their childish obstuctive replies as ive had enough of them but i plan on going up tomorrow , so my question is,  they have to give me a refund dont they, they can not bargain or refuse the refund if they havent checked the phone first ? Their previous messages have said they want to check the phone first before a refund is given and i think theyll try this tomorrow as they have argued all through this .... If that happens can i just walk away and then send the letter of Particulars which is due next week ? Edit :   Just for the record the phone hasnt been used since buying its been put in a protective bag and put in a draw , its in the same condition as i bought it

    • Hi there   thank you for the reply. No, it's not a silly question at all. I am convinced I didn't hit anything with my car. I was going very slowly and it was the guy standing next to his lorry in the road who punched and kicked my car as I went by. It's cause I saw him do it in the mirror.  I initially thought he did it because he thought I was passing him maybe too closely whilst he was messing around with his lorry ?  That's why I stopped and got out and asked what he thought he was doing hitting my car. He then just hurled abuse at me. Not making any accusations such 'you hit me' 'you hit my lorry' or you did this or that. He just swore and shouted at me. At which point I said I would be making a complaint to his company for his threatening behaviour and vandalism for punching my car. I went to my car , got my phone to take a photo of his number plate but then he came towards me again and I thought if he now hits me I am going to come second. I am a woman in her mid 50s travelling on her own and this guy looked like a Millwall football supporter (short, rotund, skin head) so I decided to leave this situation. I got back in my car closed the door and drove off before he could reach me.  I later checked my phone and noticed the photo was too blurred, as I turned and rushed back to my car too quickly before the camera could focus. So I thought it was pointless making a complaint as the guy couldn't be traced anyway, so I forgot all about it until yesterday. But this is all I can think of, it must have to do with this incident as it is in the same street.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I paid a private contractor to build me a new staircase. The guy did quite a bad job at it and I have been complaining to him for over 10 months now to come and fix it. I owe him the final payment so even he has been quite co-operative saying that he will come and fix it but is ill at the moment.

 

Anyway cut a long story short he agreed to come and fix it last week and took the faulty Railing along with him. Now he is saying that unless I give him the payment he will not return my railing. He has not fixed it nor will he fix it as his business has now shut down as he has not been keeping well.

 

So now where do I stand? If I pay him the full payment the Railing is no good to me without it being fixed. It is also not safe to be walking up and down these stairs without a railing.

 

I had allowed him to take it under good intentions and as soon as he fixed it I would have gave him his balance. Also the balance is only around 5% and I really don't mind paying it if he fixes it but he won't.

 

What are my options? Time is of the essence as without a railing the stair case is dangerous.

Does it matter how long it has been as at the same time I have been after him to fix some more steel work he has done around 14 months ago. He kept on saying he would but now he says thats its been over a year so no guarantee.

I had given him 7 days and tomorrow evening that will be up. What should I do next as it is a huge safety hazard to be walking up and down a staircase without its side railing.

 

That part and repair to the rest of the stair case will set me back around £1000.

No as he has taken the entire railing. So one side of the staircase does not have a railing or any support. The other side has a wall. So only way to make it safe would be to get a custom made railing for it.

Depends on the answer to the above, really. Can a temp repair be rigged up? There are never any guarantees with court cases, even sure fire winners can lose.

For a claim of 1k, probably not. You could be liable for some procedural costs (maybe a witness attending or something), but probably not and even if so they'll be minimal.

You can yes.
What are my chances on wining the case?
It depends on the strength of you evidence, photographs etc and whether he defends. If he doesn't you will win by default, if he does defend it will go to a hearing. If he loses he is subject to your costs and vice versa if you lose.

 

You'll have to weigh up the pros and cons. If you win will you be able to enforce the CCJ & get your money, i.e does he have the money to pay you?

 

Can you afford to lose? Although you can drop the petition at any time. i.e you can have a summons issued which may scare him into remedying the situation. If he defends & you don't feel confident enough to proceed you can drop the claim & lose your fee.

I guess I could install scaffolding but that won't be much cheaper. That will just build up my costs in case I loose. Scaffolding for a couple of months till the court case is over will probably set me back over a £1000 anyway.

If he loses he is subject to your costs and vice versa if you lose.

 

How much could I be liable for? I will go after him for the cost of replacement so a £1000 claim.

Do you have legal cover on your building insurance? If so it might be worthwhile to have a word with them.

I have proof that he has taken away my stair case and won't return it. Does that count for anything?

It's all evidence yes, along with photographs of how he's left things. There's nothing more damning than pictures.

 

It may be worthwhile having a word with trading standards too they may be able to help & also tell you if he's 'known' to them.

Will see what they have to say tomorrow. What would my liability be in this sort of a case if it went to court and I lost? Last thing I want is to be given a 5k lawyer bill from his side.

Any costs you incur plus perhaps £50 - £200. Caveat - that is an extremely rough estimate. In this type of case you won't get hit with his lawyer's fees.

 

The reason I asked about a temp repair is that it is worth minimising the initial costs in case you lose. You also have a duty to keep costs to a minimum.

The point raised above is also valid - even if you do and win, you need to be certain you can then get your money. I sense that this is a much more complicated case than it might seem and I'd therefore be very reluctant to give firm advice on what to do or what your chances are.

 

It is also important to figure out who you are suing - you say he's been ill and has shut down - was he a ltd company or a sole trader? If a ltd company and he's shut up shop you'll not be able to sue.

He owned his own company and now has shut up shop. I know he is still well off. Not sure if he was a PLC.To be honest with you if I am only liable for what is mentioned above then I prefer to go ahead with the case as anyway I am shelling out £1000 for a new railing so its not as if I am loosing money. Will just cost me the extra for the MCOL case.

 

I would like to show him that he can't do this to people and at least the court case will make him a little uneasy.
