Ell-en has helped hundreds of people she is off line at the moment but im sure she will be about tomorrow you have time it will take a week to get the warrent and then 14-21 days for a date to come through or longer so if you can pay Octobers and possible Novembers before any hearing it would be good

Hi there, sorry to hear you are in this situation. Try not to worry too much, we can always do something to help. Also, don't feel you have been stupid - people find themselves in financial difficulty for all sorts of reasons and if you read around this repossession forum you will see how many people have been (and still are) in your situation. You mustn't allow blame or shame to cloud your determination to resolve this situation, and we are all here to help you do just that:)

 

The best advice is to carry on making payments until you hear anything else. If SPML do apply for an eviction order we will enter a N244 application to have the eviction stopped (I can help you with that, so don't worry). Provided you have an income and can demonstrate that you can pay something towards the arrears you will be ok.

 

Did you attend the repossession hearing in May?

Thanks Ell-enn, no we didn't attend the repossession hearing although now in hindsight I know we should have, but it was a case of us burying our heads in the sand. We now have a monthly income of around 1700 per month now that my partner has got a new job. After we have paid October's payment we will be setting up a monthly DD from a new bank account that we are setting up, purely for the mortgage payments. Will that stand us in good stead with the courts, should it get that far?

Hi there, if you can keep making payments until you hear from SPML that will help your case. We can then put everything together for an N244 if need be.

 

In the meantime you could write to them, enclosing your budget sheet, explaining your circumstances and offering the payment towards arrears, this would show the court you have tried to come to an arrangement.

 

If you need me to draft a letter for you I'm happy to do so.
