      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, I'm also new to the site and wanted some help on agreements with Perfect Home, My daughter has 3 agreements with them for a TV, Washer and TV stand. Could someone please explain what the 3 separate payments are on the front of the agreement. I presume the Hire purchase agreement is for the price of the goods this also includes interest, then there's the fix-sum loan agreement this also includes interest????? what is this, it does have a clause stating that this can not be cancelled. Then there is TAD which i understand to be Theft and Accidental Damage, as she has no house insurance (silly girl) she also signed up for this.

What i want to know is she has just recently split with her partner and is also on income support as she has two children 5 and 3 to look after, can she write and ask for a reduction to her weekly payments as she has paid well over a 3rd on each item and is there anyway she can cancel the fix-sum payments.

 

Any help would be appreciated, Many Thanks

I used to work for PH so know what i'm talking about.

hire purchase ag is for goods

fixed sum loan ag is for coverplus which is OPTIONAL

tad is theft and acc damage which is mandatory if you dont have contents insurance

Because she took out the Fix-sum loan aggrement, i really dont think she knew what she was signing.

 

Under Key Information it states No cancellation rights, You have no right to cancel this Agreement under the Consumer Credit Act 1974, the Timeshare Act 1992 or the Financial Service (distance Marketing) Regulations 2004.

 

You stated its optional but is that option only given at the time of signing and is she tied into this.

Hi,

you can cancel the cover plus at any time but means that if a fault develops with any goods after the first year, any repairs are chargable. Company policy is that the customer writes a letter to the manager asking for removal of coverplus, and it should be removed in 14 days.

any arguments or refusals regarding this and you have the right to get the financial ombudsman involved. and they WILL sort it.

No dont worry I wont, they got her to sign all these aggreements without her fully understanding what she was signing, she has only just told me about all this as shes now on her own and struggling, so I'm helping her best way I can, but lol they may be able to bully her but they havent met me yet, I challenged the CSA years ago and ended up with £50 compensation (lol not much, didnt know wether to cash it or frame it) as they had done everything wrong. So will start on PH now i have been given this valuable information.

yes! if you look around the ph store it says 'optional cover plus'. when i managed a store i was told to cancel it where requested by customer. I know some managers put up a fight because they are targeted on it.

Thats why I mentioned about the ombudsman service, they take misselling seriously and the last thing PH need is them getting involved.

let us know how you get on!

oh and for the record, the 'no cancellation rights' is codswallop. if you want goods collecting then PH will happily cancel the agreement.
