    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Merewynkitt and skbunks - Although I am not sure what the courts directions are for the banks filing their bundles (usually 14 days prior to hearing) invariably they will not and this link may prove useful:

http://www.consumeractiongroup.co.uk/forum/lloyds-bank/58011-sc-m-court-bundle.html

The issue of the non compliance letter may prompt a settlement offer.

LMAO this is going to be one longggggggggggggg thread if you are going to count down every day ..also if you need any advice in the future it's going to take forever to scroll back through your thread to see what you have done so far .

ADVICE = we can see how long you have left so don't post a countdown every day :)

I was going to suggest getting a countdown from tickerfactory to put in your signature so that you didn't have to post a countdown message each day... but you have won now anyway :)

Congratulations! Enjoy spending (or saving) your money.

Lloyds have acknowledged my claim and paid out £625, just waiting for the rest.

Having came accross GaryH's two threads

http://www.consumeractiongroup.co.uk/forum/lloyds-bank/65921-application-costs.html

and

http://www.consumeractiongroup.co.uk/forum/guidance-notes/64911-got-court-date-guide.html

I intend to pursue Lloyds for my expenses incurred in pursuing this claim. Given the run around they put us through I believe it to be true and just for them to be penalised for their abuse of us and the court system.

Indeed I know of one instance where someone has been granted £950 in 'compensation' http://www.consumeractiongroup.co.uk/forum/rbs-bos-successes/49470-contractual-interest-details-case.html against RBOS. This was for inconvienience caused, distress caused, priniting costs, exemplary charges and aggravated damages.

My Expenses so far

Printing/photocopying at 10p per sheet for 386 pages = £38.60

Postage = £9.76

Time charged at £9.25 / hr

Preparing DPA - 1 hr

Preparing Prelim and schedule of charges- 5 hrs

Preparing LBA - 1 hr

Preparing allocation questionnaire - 1 hr

Researching relevant case law and regulations - 40 hrs (although was probably much higher becuase i spent a lot of reading up on the subject)

Preparing court bundle - 5 hrs

Gives a total of 54 hrs = £499.50

Grand total £547.86. This seems a bit high to me but then I have devoted a hell of a lot of my time to this since May 2006. However CPR 27.14(2)(g) of civil procedures for small claims track does state

The court may not order a party to pay a sum to another party in respect of that other party's costs, fees and expenses, including those relating to an appeal, except – such further costs as the court may assess by the summary procedure and order to be paid by a party who has behaved unreasonably

Although I have still to receive any correspondance from [problem] or Lloyds informing of there intent to settle so should I wait until I have received such a letter or just press on with it now??

Letter now sent to and received by Sheffield Court for costs. Claiming £530 ish, more or less same breakdown as in post# 68. Will nom have to wait and see what the court thinks.

Strangely enough when I got home from work on monday after sending the letter there was one waiting for me from **** on my door mat. The letter was supposedly in response to a phone conversation we had had (despite never having spoken to them in my life) offering me full settlement etc and could I let the courts know they had settled. Well thats covered in costs letter so no problems there ****.

On a different note how do I change my thread title to WON and move it to successes forum??

  • 2 weeks later...

Update on costs application - denied

OK, have just spoken to the court, the judge read my letter and decided in all his infinite wisdom that my time, effort, distress and anxiety was worth zilch. No reason given guess I might have been asking for too much

Chalk that up as 1 point for Lloyds. Thats makes us on a 1,1 draw so time for a rematch. Lloyds credit card charges here we come
