    • Interesting question regarding what Government accounts opposition parties have access to, before an General Election. From what I understand, Government department accounts that are published are always lagging behind and would not include some amounts which are classified as 'commercially sensitive'.  Therefore opposition parties and Parliamentrary select committees would not have access to accounts which contain real time up to date information. If a new Government have found £20 billion of spending liabilities they did not know about, this could be true, as £20 billion is not that much when you look at total Government expenditure. Government department are making decisions on spending all of the time and it could be the previous Government were planning tax changes and/or spending cuts to balance the books.  Jeremy Hunt has recently said that if the Tories had stayed in Government and held an Autumn budget, it would have been very difficult to cut taxes as some had wanted.

Paragraph 16 and 17 says  you did not contract with evri but this is not true - see below  Furthermore to the eBay Powered By Packlink T&Cs that Evri is referring to, Clauses 3b and c of the T&Cs states:  (b)   Packlink is a package dispatch search engine that acts as an intermediary between its Users and Transport Agencies.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good afternoon, Im after a bit of advice please.

 

I took my Renault Scenic into the local main dealer to have an injector seal fixed on Friday (£300) I thought id take it there as it was engine work and would be under warrantee and I would have the use of a courtesy car. I collected my car on Saturday apparently fixed, took it home and didn’t drive it until Sunday afternoon. On Sunday whilst driving round town I noticed a diesel smell whenever stationary but I thought it must be whatever they used to clean the engine bay as it says "Cleaned down cylinder head" on my invoice along with "Kit Cleaning ENG" for which I paid £12!

It wasn’t until I got on the motorway I noticed the back window was getting very dirty but thought nothing of it. I got to my exit and pulled off onto the right hand lane of the slip road and applied the brakes. The car swerved violently off to the left and I cut into the left lane of the slip road, luckily there were no other cars. Having recovered from that I tentatively applied the brakes again but it was obvious they were faulty and only just brought the car to a standstill with a lot of pull to the left. I would never have been able to stop cleanly if I had to apply the brakes in an emergency on the motorway.

 

It transpires that when the injector work was carried out they created a severe fuel leak from somewhere, this fuel was spraying around the engine bay, dripping out the bottom and being distributed by the air flow onto the drivers side wheels and brakes, the entire underside of the car and up to the back window.

 

The recovery guy who collected us refused to fix the leak as the car was unsafe to drive and recommended new tyres, brakes and a full steam clean.

 

I called the dealer this morning and they sent a truck and delivered a courtesy car but I would like to know what to ask for both in terms of compensation and replacement parts as im sure they will fix the leak but may be hesitant to do anything else. Should I go in tomorrow with a list of demands or wait and see what they offer.

Hi and welcome to CAG.

 

Did you get a report from the 'recovery guy'? If not, can you get one which will show the problem as you may need it later on. My take is that the dealer will realise that the break down was a result of their work and will repair the car without any cost to you. They may even present you with a big box of chocs or something. Of course you can ask them what they intend to do about your near-accident experience and see what they have to say about it and you do have the option of taking the matter further by contacting Renault UK or better still, VOSA. I would wait untill they have dealt with the problem first though. Please let us know the outcome.
