    • All of the services listed in the upload link to convert to pdf and/or edit pdfs are online, which means you are uploading your documents to another's servers for the merge, and whilst some claim to delete the files within a given timeframe, we have no method of validating this. And so I avoid this, as I do not want my personal and often sensitive information to be in the hands of another. I'll upload to my website and/or one-drive and provide shareable links instead, this way, I remain in control and everyone shall be able to access my documents - there's much, much more than just those two
    • If you simply respond to the NIP and request for driver's details promptly the police will simply process it in the normal way and either offer you an out-of-court disposal or take court action (and which of those will depend on the speed and limit and your eligibility). They do not routinely ask for proof of insurance and there seems no reason why they should do so in your case. £300 and six points is the fixed penalty amount for no insurance. It can be more if the case goes to court. There is provision for n unlimited fine, up to eight points or a disqualification.   That is all as far as the penalty goes. However, you should not dismiss it too lightly. An endorsement for No Insurance will probably double your insurance premiums in the first year. As well as that, if you also have one or two speeding endorsements, the increase will be considerably more. In fact in those circumstances some of the mainstream insurers will refuse to cover you at all and you will have to go to a "specialist" (which means very expensive) broker.

    • Oh that is very helpful, thanks a million for answering my query. Looking at the license right now. At the front it says the issue date is 2022 (that's when I swapped it), but at the back it says 2015 next to Category B. So, I'm definately at 12 points, right?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

I have been outside the UK since early 2003. I have been in Latin America. However had several outstanding balances that I couldn't afford to pay and left it as that. I know since my departure there has been several times that Bailiffs did send letters to my mother's address in the UK, but she basically returned their mail.

 

I know I have 2 CCJ's before I left the UK, and I am certain I may have some more right now, looking at all the other responses I would like to understand what can the DCA's do in this regard. I read something about 6 years or more, but can someone clarify this that a debt cannot be enforced as such after those years have passed. Also that I have never been in communications with any of the companies that I was in debt with since 2003.

 

I am more than scared of returning back to the UK, as perhaps I may be arrested on the spot at the time of entry due to the CCJ.

I just wish to visit my family there.

You certainly will not be arrested on the spot as debt, including CCJ's, is a civil matter and not a criminal one, certainly you will not be on the UKBA database, so you will not be stopped at the port of entry.

 

I am not an expert on these matters but as I undertsand a CCJ cannot be obtained against a non UK resident, if one is, possibly by using an old address and getting judgement by default, you can apply to have the judgement set aside. You can check if you have a CCJ here, http://www.trustonline.org.uk/ there is a fee.

 

If you had a CCJ before you left the UK it will not go away but it cannot be enforced after six years without leave of the court. I undertstand that leave is not often granted but sometimes it is, being out of the country might be considered grounds, but I'm not sure.

 

Rest asuured that they will find if you live in the UK, but you certanly will not be arrested.

Agree with above.

Some debts can still be chased after 6 years such as Council tax arrears,HMRC and some others like Social fund loans,but if the debts you had relate to things like loans,credit cards etc,then they should be statute barred.

Thats not to say that the DCAs wont try to collect-they probably will !!

Thank so much for your replies. It's not to do with any debt like council tax or monies taken from loans as such. It's just credit cards and unsecured loan. Does that mean when I do travel I shouldn't open any bank account as such and stay clear from any of the financial offerings. As I only wish to visit but would like to slowly move there if it does allow me too.

 

When you say non resident - I hold a British Passport would that still apply at that time as I wasn't in the UK if they did use my previous address to get a CCJ?

Usually when you open an a/c with a bank etc they check your history over the previous five years, your history is that you lived abroad for 8 years. As long as they cannot link you to a previous UK address you should be OK.

As for any CCJs, any that are six years old automatically drop from the data bases. Any enforcement action would require the permission of a court... which is rarely if ever given, besides they would still have to provide case reference numbers before they could try to pursue.

Thanks so much for your reply. I think it would be best to keep myself with a low profile. I have a bank account in the USA, which I can use over there so I hope this shouldn't cause any problem. Of Course as far as the address they have my family home address, as my mother sometimes does receive letters which she sends back. But I am just scared of visiting my family just in cased they stopped me at the airport due to the debt. But I gather from the above and this wouldn't happen as it's a civil matter.

 

Is it true that If I ddin't acknowledge the debt since 2003 it would be wiped after 6 years, or would they still be able to pursue this matter through courts. Thanks

If they haven't taken legal action within the six years and provided you have not made a payment or written acknowledgement then they cannot take any legal action. Once a debt becomes Statute Barred it remains so and nothing can un-bar it.
