      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I need advise on this please,

 

used to have an egg card in the past but the account got cancelled when they got taken over - cos of my good relationship with them I advise my wife to apply for an egg card and move her balances to enjoy a period of 0% Apr.

 

Only problem is she didn't move the balance and won't get approved for another Ccard, she has been paying for months but the interest applied to the account is £70 when she is paying £80 by DD. I have just asked to look at the account and just couldn't believe it.

 

She is on maternity at the moment and has decided it would be more expensive to go back to work, all maternity payment has been paid and she is not earning anymore.

 

Egg keep calling the house phone so I paid £142 on my card, to balance the account + interest, I asked the customer service why the huge interest he said she was notified of the increase, which she can't recall.

 

 

Now my question is can they just keep increasing their interest rates like this? and where does my wife stand in regards to paying back the debt? I told egg on the phone that I am willing to make the payments since my wife is not working but will not like to be paying such interest.

 

I have also put this into writing(in her name) to their card services highlighting that I will give her some money to pay some debt until she can find a job that fits into our lives but on condition that they stop charging interest.

 

The letter arrived there 25/08/2010 still waiting for their response.

 

Also do you think they can send someone round the house etc - since all property is in my name will they be able to take anything if it comes to that?

ok now receive a reply to the letter saying she should call them to discuss how they can help - stating various options and they will access her during this call to see if she is eligible.

 

Should she call - i am advising yes.

That was a ruling effective from January 2009 by the regulators who license Egg as a credit card, not by the chattering classes.

 

No harm talking to Egg so long as you/she is not stuck with a clerk on the bottom rung of the Egg food chain, able only to repeat answers from a standard Egg script without variation. No harm showing a velvet glove, so long as you make clear there is a steel fist inside it. If Egg will not play ball re extortionate interest rate rises at a time of virtually 0% interest rate from the Bank of England, then they can face their regulators, and they should be left in no doubt you know chapter and verse.

Since the last time we have sent 2 registered letters to egg, with bank statements and payslips though showing £0 on the payslip.

 

Egg still keep calling for our Income/expenditure - I told her (my wife) since I have nothing to do with the debt they have no right to ask for my income/expenditure - they can ask for your which effectively is shown on your bank statement.

 

They still insisted she should send something in showing £0 in £0 out before they can make any decision. We have asked for a paying in book which they haven't sent, so i advised her to cancel all DD on her account.

 

I am currently covering all her bills and have offered egg £20 p/m until she gets another job.

 

How do you write an income expenditure with nothing in it?
