    • Northmonk forget what I said about your Notice to Hirer being the best I have seen . Though it  still may be  it is not good enough to comply with PoFA. Before looking at the NTH, we can look at the original Notice to Keeper. That is not compliant. First the period of parking as sated on their PCN is not actually the period of parking but a misstatement  since it is only the arrival and departure times of your vehicle. The parking period  is exactly that -ie the time youwere actually parked in a parking spot.  If you have to drive around to find a place to park the act of driving means that you couldn't have been parked at the same time. Likewise when you left the parking place and drove to the exit that could not be describes as parking either. So the first fail is  failing to specify the parking period. Section9 [2][a] In S9[2][f] the Act states  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN fails to mention the words in parentheses despite Section 9 [2]starting by saying "The notice must—..." As the Notice to Keeper fails to comply with the Act,  it follows that the Notice to Hirer cannot be pursued as they couldn't get the NTH compliant. Even if the the NTH was adjudged  as not  being affected by the non compliance of the NTK, the Notice to Hirer is itself not compliant with the Act. Once again the PCN fails to get the parking period correct. That alone is enough to have the claim dismissed as the PCN fails to comply with PoFA. Second S14 [5] states " (5)The notice to Hirer must— (a)inform the hirer that by virtue of this paragraph any unpaid parking charges (being parking charges specified in the notice to keeper) may be recovered from the hirer; ON their NTH , NPE claim "The driver of the above vehicle is liable ........" when the driver is not liable at all, only the hirer is liable. The driver and the hirer may be different people, but with a NTH, only the hirer is liable so to demand the driver pay the charge  fails to comply with PoFA and so the NPE claim must fail. I seem to remember that you have confirmed you received a copy of the original PCN sent to  the Hire company plus copies of the contract you have with the Hire company and the agreement that you are responsible for breaches of the Law etc. If not then you can add those fails too.

    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Careless, I know, but I have absolutely no idea how much my bank has taken in charges in the past 5 or 6 years (which is it? I live in Scotland).

Will they send you details if you simply call/ email or should I go into writing for this also?. If in writing, is there a template available requesting a detailed breakdown?

ps....it would be handy if they would either email or burn details on a CD in a spreadsheet as my charges will be too frequent to type!!!

Many many thanks for your advice.

I am hearing conflicting information about the system in Scotland...

Is the qualifying period 5 or 6 years?

and

Does the small claims court have a limit of £1000? If so, I'm not sure what to do as I reckon my claim could be around £3K

HELP PLEASE!!!!!

OK, so after reading and getting advice from other forum members, I went into the bank yesterday and handed over the DP form requesting full details of charges over the past 5 years. They are charging me £20 as I have 2 accounts...Is that right? They will debit the amount from ny account.

This morning, a letter arrived (1st class) which was partially hand-written, not dated and did not have a post office frank over the top of the envelope. The letter said they wrote to me to arrange a banking "review" recently as they feel it could have been of great benefit to me...etc...etc. If I would like to make an appointment please call. The thing is, I never received that letter in the first place.

Just a coincidence???? Has anyone else received this?

I'm not sure whether to:

a) make an appointment

b) write saying that I will do a review once current "enquiries" are resolved

c) Ignore it

Any advice will be great.

Ok, so I think I'll write to RBOS thanking them for their invitation for a "review" I will however decline in the short term, pending ongoing enquiries etc etc.

Probably a good idea to do this in writing instead of calling. Must admit, cant wait to see my statements so I can calculate how much I have paid over the past 5 years. I reckon it will be scary!!!

Do I understand this right???

When informally asking for my money back - I ask for full amount (c£3k)

AT LBA - Seek only £750 including interest and costs

At Legal - same as LBA

or

Do I stay with the full amount for the LBA?

Thanks

Maybe its just a coincidence, but just went onto digital banking and it will let me see current balances, but nothing else......no history, no transfer facility. Strange.

Also, I live in scotland and my bank (RBOS) is in Scotland. Can I still claim in England? Any advice would be great.

Noticed that SAR fee had not been debited from my account so called local branch to check progress. I was told that the enquiry had been forwarded to their office in Gogarburn (???). Will hopefully get a call back today.

Does anyone know the answer to my question on which courts you can use, ie English/ Scottish?

I can see that a lot of people are looking at taking on H/BOS in England. Can we do the same with RBOS as I dont know if they have a head office in England? I know I can do the RBS C/C through the English court system.

If I can, then its woohoooo!

Just waiting for the accounts to come back from Gogarburn. Then plan is to take the claim South. Has anyone had success doing it this way?:?

I handed in the above request at my local branch on Friday 1 September 2006. At that time, I gave 40 days notice to reply and, whilst that time has not yet expired, I have heard/ seen nothing. I trust that this matter is in hand and is being dealt with at the moment.

The latest date for receipt of this information is 11 October 2006 and I thought I should write a brief reminder to ensure that this matter is processed in a timely manner, and to avoid any breach of your obligations under the Data Protection Act.

I look forward to hearing from you in early course

zzzzzzzzzzzzzzz still nothing ( I know I am impatient). Still, while waiting I have been wondering about the interest rate and whether to go after contractual interest and notify the bank at Prelim stage:rolleyes: . I noticed one or two people getting contractual rate. Note that I am being greedy, but 20 odd % does sound tastier than 8%; no?;-)

Any advice would be loverly. Ta.

Not as much as I hoped for, but still just north of £2K. Hope it gets as far as court stage as I will then get about another £400!!!

Anyway, Prelim off recorded delivery today, sent to Retail Regulatory Risk division. Shame they are not based in Glasgow, as their initials would then be GRRR! (which is exactly how I feel)

Oh well, 14 more days of fun till the next deadline!

Looking at the postcodes, they look pretty close to each other. I dont spose it will make to much difference, but I will keep replying to the last person to contact me, that way It should always land on the desk of whoever is dealing with my claim.

mixed opinions.....some people let them have the remainder of the 14 days in case they have a change of heart. Personally, I would take the "go away" letter as their answer. Off to LBA stage methinks!

NEWS!!!!

Mr McLean just wrote to me explaining that their charges were fair (really?), reasonable ( ) and ...erm....transparent (hence the secrecy). Oh and guess what??? I'm not getting my dosh back!

It kinda gives you that warm fuzzy feeling. The same feeling everyone else must have gotten that received this "standard" response.

That's it! Ive just downed another can of spinach and am really up for it.

OK - so have spent the weekend thinking of how best to approach Tommy. I think he is probably doing his best under pressure, but I would like to let the bank know how I feel and what my intentions are. I have therefore come up with the letter below. Any comments gratefully received before I stick this in the post/ email.

Thanks

RBoS

LETTER BEFORE ACTION

Dear Sir,

ACCOUNT NUMBERS: xxxxxxxxx and ********

I am in receipt of your letter dated 17 October 2006.

I am very disappointed that you have failed to respond positively to my letter of the 11 October 2006 and as detailed therein, I am now prepared to give you an additional 14 days to refund these unlawful charges as detailed at Annex A & B attached.

I am aware that there are many thousands of people currently pursuing a similar course of action and, in one forum alone, there are details of Banks and Credit Card companies (RboS included) returning approximately £2M under circumstances remarkably similar to mine.

Whilst I am more than comfortable in pursuing a full refund of my charges through legal action, I feel it is only fair to afford you this final opportunity to settle my claim in full, thus negating the potential on-cost of administration, legal costs (both yours and mine) and interest @ 8%. With this in mind, I am prepared to wait until 6 November 2006 to receive a full and final settlement of £****

I would therefore be grateful if you could advise which route you would prefer in early course. Should I not receive a satisfactory reply by 6 November, I will file a claim at court without further notice to yourselves.

As an afterthought, I find that RBoS’s reluctance to refund these charges, taken unlawfully, to be particularly disturbing. Whilst I understand any business must make a profit to succeed, surely the income generated by penalising those without a substantial level of disposable income is profiteering in its crudest form.

I trust that this matter may be resolved quickly and amicably and look forward to hearing from you in this respect

Yours faithfully,

weej
