    • Hello, firstly thank you for reading this. I know no one wants a long winded back story. So I’ll be breif. I entered a local store to buy some paint (which I did pay for) I am honestly not a bad person or a theif.   Didn’t have a basket or trolly as was on my lunch break. Whilst picking up the three tubs of paint placed some masking tape in my pocket (it was hanging out of so I had every intention to pay) just didn’t have a hand free. Paid for my goods (forgot about the £4.39 masking tape) I’ve got so much going on and im not well at all (like I say no one cares I get that) also have autism so wasn’t thinking particularly like others do maybe (who knows my minds going around and around) I left the store after paying, was pulled back in by security. Asked for the tape which I gave immediately  shook up. Gave them my ID and details. I was given some paper and told to expect a large fine in the post for their time and the tape and sent on my way. my questions are: I hardly ever go out without support so the ban I guess I can’t go there now for anything (their loss) - ok but is my photo going to be all over with my name? how much am I expecting in the post as a fine? I have sent them cash in the post recorded signed for delivery to arrive tomorrow (incident happened today) for my error. Their Address was on the bit of paper. i have read two posts on this page but they were from many many years ago so I hoped for updated advise please?

    • utter BS, doesn't matter you signed it. pers i'd be writing as per the other threads here rejecting the car as not as described under CRA etc and be done with it. as its a debit card you could also do a full chargeback within 120 days to your bank and simply dump the car back to BMW. 100's of like threads to read here. get your ducks inline. make sure you know what you are doing and off you go. dont take any BS from BMW, no matter what you sign it does NOT remove your consumer rights. p'haps it might be on the off chance you are a good manager , a quick phonecall tomorrow saying you dont want it because (no bla bla fitted) it might be resolved in 5 mins..i will guess to date you not tried

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

im new to all this but i do have a major problem with the Natwest Bank over my Buisness Account.

 

Last week Tues 20th July 2010 my wife went to the cash point to draw out her money from her personel account. Both her cards was taken by the cash point machine. So she then took a drive to the bank to find out what was going on. The bank told her that both our personel accounts was unoperative and also our buisness account.

 

So after many phone calls to the Natwest i found out the problem. The bank hadnt taken out the buisness loan payments on the agreed dates. This putting all our accounts over to Triton.

 

I have made several calls to the Natwest and have allways been thrown over to these clowns - TRITON

They are saying that i should have recieved letters about the 2 non payments, and guess what now letters have ever came here.

 

Now Triton are saying that the Natwest no longer want my account and also the 2 personel accounts.

 

I rang Triton to sort this out. They are saying that they recieved my accounts on the 16th July 2010. Today is the 27th July 2010. And still no written letters stating to me what is going on.

I have money in the buisness account that is paid to me by BACS from the Notts County Council. Triton will not release me any money to continue running my buisness.

 

So again i ring the Natwest. Hello can i speak to my non existing Buisness Manager please. and there answer was " Sorry he has been on long term Sick. Can i have another Buisness Manager to help me please " NO " was there answer.

So my question to them was " So i have a buisness account i have been paying for 7 years, what exactly have i paid them for".

 

I have found a couple of things out so correct me if im wrong.

 

Firstly - the monies paid into that account comes from my local County Council. This is government money they legaly cant have a hold over unless my account is under Police investigation or Fraud investigastion.

 

Secondly- The RBS = Natwest was bailed out and told to support small buisnesses. This has not been done for me.

 

I am at the moment looking into loss of earnings with these clowns as if i cant get money out of my account, i cant work. Cant work = no mortgage payments. bills etc etc

 

Also a counter claim for od charges and account charges as they sold me a buisness account they agreed to and have not supported.

As in NO BUISNESS MANAGER AVAILABLE

Firstly, is your wife a partner in the business account, as in a 'joint' account. What have they done with the money in her account, is it frozen have they taken it towards the 2 missed payments or what?

 

Was the money to cover the 2 missed payments in the account, or was it not there for them to take?

 

You must immediately open an account with another bank and arrange for all income to be paid into there. Cancel all Direct Debits etc.

 

Others will be along to advise on the other aspects for you.

The Buisness account was in joint names. That bit isnt the problem as Triton was told that the money in the personel accounts was child tax credits and they had to release it by law. So now both accounts are empty and now with the TSB. That was done 2day.

 

A new Buisness account has also be opened in my wifes name. That was done 2day.

 

The problem now is that Triton will not release monies to me to continue to run my buisness.

 

As ive told them, no money = no buisness = not able to pay back.

 

But these IDIOTS at TRITON dont see that.

 

Are the Natwest enjoying the fact that they do not support small buisnesses as they promised the government after being bailed out millions?.

Ray welcome to the site.

We have many business account customers here on the site,who have suffered a variety of injustices in various scenarios between all the banks.

You speak of loan repayments being missed which is the excuse they are giving here ?

What loans are they-I assume they are regulated under CCA ?

When were the loans taken out-are they on the business account ?

Have you been sent default notices ?

How many payments were missed ?

How was the account operated prior to this ?

We need some more info to see what recourse you have here.

The loan came about by the bank offering to make things cheaper and changing the overdraft into a loan.

 

The account has been running well, monies paid in from County Council by BACS, taxi insurances coming out by DD and it was running fine.

 

The bank said i was sent a default notice in June. I did not recieve such letter.

 

2 payments was missed by the fault of the bank not me.

after days of phone calls, i was finally let to get the money out of my buisness account. This has been transfered to my new account. After speaking to those idiots at Triton, i have agreed to pay them each month, but only if i have it in black and white and that i can sign it.

 

I dont trust their over the phone guarantee. So now the old buisness account is cleared out and they have no hold what so ever over my monthly income.

 

But my argument to them was and still is, the direct debit was to be taken out every month on the 28th. The bank was doing this untill April. Then they was going for the payment on the 7th of each month. As all people in the taxi buisness knows, car upkeep and car repairs become expensive, and thinking they had allready taken the direct debit i wrote a cheque to pay for a new engine.

 

But after 3 months i get all this hassle with," we have sent you letter after letter". I have told these people i have not recieved such letters and defaults but they insist they have sent them. I know i havent recieved them as anything that comes from the Natwest is put in a file.

 

So now i require some guidance. I have since found out that the Natwest have broken their terms and agreement of The Buisness Account.

 

Firstly i have paid them each year for a service that includes a local buisness manager to support me and my buisness. My first 2 managers was based in Manchester. 75 miles away. Is that local. NO

 

Secondly 10 months now and my appointed new buisness manager has been on long term sick with no stand in.

 

So where has The Natwests support been to me. I have paid all their charges for the account and for the odd accasion of being over drawn.

 

Can i counter claim against them on this issue ?

I think you have a good case for some recourse,however you are going to need evidence for most part.

I think it is therefore essential that you get as much as you can to build a case-you will need this whether you choose to take it up with the regulators or else a Court claim.

A SAR should get you this.

It needs to be substantial and specific and cover everything to include copies of letters,screenshots of account activity,copies of your business manager decisions/reports etc etc.

 

There looks to be relationship issues as well as duty of care,fiduciary duty,and conflict of interests.
