      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well its that time of year again, the temerature is slowly creeping up and it will be summer before we know it :) so who's interested in another meeting in Brum?

 

The last two have been during August and the Pitcher and Piano was a great venue last year :) so who's up for a summer meet?

*health & safety alert* shall i order a bulk supply of water wings? :D or just for babybear who nearlly went in head first :eek:

 

I think a bit of rope to tie BB to the railings will suffice :D... just means one of us will have to keep her voddie supply flowing :p

I did this map last year which no one took the slightest bit of notice of so I thought I would post it again for everyone to ignore :rolleyes:

 

Note to drivers, Paradise Circus Queensway is actually a very large traffic island so its one way clockwise and part tunneled :grin:.

And here's the road map :-) I think the easiest way to the city center from both North or South is along the A38 from either junction 6 of the M6 to the North of the city (spaghetti junction) or junction 4 of the M5 to the South of the city.

 

From the North.

 

Exit the M6 at junction 6 and follow the city center signs, this will bring you onto the A38(M) this is elevated to start then through a culvert type affair... keep following the city center signs and you will go over a big curving flyover and then into the first of the tunnels under the city... stay in the left hand lane and exit the A38 after the first tunnel, straight up the hill and through a set of traffic lights and you will be filtered onto Paradise Circus Queensway (detailed on my first map) the 3rd exit is Broad Street.

 

From the South

 

Exit the M5 at junction 4, take the A38 (third exit) from the traffic island the signed Birmingham. follow this for about 2 miles until you get to another traffic island (Longbridge) take the first exit (still the A38:cool: and follow this through Northfield and Selly Oak eventually (about 6 miles) you will come to a large set of traffic lights (8 lane I think) with a McDonald's Drive through on the left straight on for about 700 yards and into the first of the tunnels under the city from the South, stay in the left hand lane and exit the A38 after the first tunnel, you will then be filtered onto Paradise Circus Queensway (detailed on my first map) the 1st exit is Broad Street.

I happened to be in the area the other day so I did a walk by health and safety assesment :D.

 

You will all be pleased to hear that although the barriers in front of the canal remain few and far between (and collapsable) the furniture has all been replaced with much heavier wooden tables and chairs that should be bear and sally proof lol

I am still in the land of the living Great to see everyone had such a good time :) I think I did too.... from what I can remember anyway the weather wasn’t kind to us but with such a great bunch of people and a little lateral thinking and a quick change of venue it couldn’t dampen (or dilute lol ) our spirits.
