      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Employer refuses to pay professional subscriptions

I have made other posts-been off five months with work related stress -however, the matter has got worse over the weekend.

 

My employer has always paid (and pays all employees professional subscriptions), however, I have received reminders for my subscriptions this last weekend as none of them have been paid -they total £207.00 which is a lot considering I am on sick pay at present.

 

I have followed the normal procedure and sent invoices to employer -and emailed -to ensure that have received them. Any advice -although not included in my contract it is a verbal agreement -and historically has always applied -HR fees, director fees -re membership/subscriptions are paid.

 

I was given a gift card for £10.00 form my employer -last christmas -all employees receive them for a supermarket. I dont use this supermarket but went last sat -give in my giftcard and it showed a nil balance. I was told to go to custsomer serv -they agreed no remittance had been added. I was asked for the receipt -which had not been sent to me.

 

I realise it is only £10.00,but it is the principal and I felt a total fool. This just tops everything which has gone on with my employer. I have been off five months -and still no further forward -they refuse to accept grievance letters -say that an informal meeting should be held -this was held last Oct -with MD-who is denying this, and other director insists I have meeting with MD -ridiculous when grievance is with him.

 

He has been very sarcastic to me, wanted to reduce hours from full time to part time -I wouldn't accept and he told me to ask my mum to assist me financially. Also very sarcastic about my health -have long term back problem -over 15 yrs and is trying to stop me attending medical appointments. Last time I went in hosp he tol me to hand my keys over as I was going into xxxxxxxx hospital -and I may not come out. This hospital was having a bad report at the time-and still is -but I have got to go in shortly for surgery again -and this comment is always on my mind.

 

Any advice please:

 

non payment of professional fees

nil balance on gift card

 

any help/assistance will be appreciated.

Hi there. I don't know the exact rules on this, hope someone else does. If the subs isn't paid, will that impact on your job?

 

Some professional subs can be reduced on grounds of long-term illness - have you looked into that at all?

 

Regarding the grievance, I read a post earlier by Elpulpo, I think it was, that said an employer should not cause undue delays. I'm sure people will have ideas for you.

Non payment of subs will have an impact on my job -and will incur numerous penalty charges -I have notified both bodies of the current position and have ten days to sort the matter out.

 

I have read the post regarding delays by an employer -and the acas guidelines which state exactly the same. I cannot believe that they have acted in this way -unlike other employees who have been off for any length of time -they have always been rung by HR or work director -to enquire about their health etc. I have had no contact etc from HR -or anyone else to enquire about my health etc.

update -not paid yet subs.

 

Plus underpaid this month -no payslip checked statement -and appears to be paid ssp 79.15per week for march -when in fact we have a disability scheme -to guarantee salary at 50% -clealry not used.

 

Really stressed out -off for a further month by GP, this is second time my pay has been incorrectly calculated -in five months. Cannot afford to pay my subs -207.00 when only been paid 320.00 for month.

 

Really stressing me out now with money situation.

If you are being underpaid (and failure to pay subscriptions may also count as this if you have a contractual agreement to have them paid for you) you need to formally raise this with your employer ASAP.

 

If need be you can file an ET claim for unlawful deduction of wages but there are strict time limits. Check with ACAS then address this asap.

Hello there. I would check the exact terms of the disability scheme. If it's an insurance one, they often have a deferment [waiting] period of 3-6 months.

 

A good employer normally states in the contract of employment how long an employee receives full or part salary. Do you have your Terms and Conditions at home, or an employee handbook?

 

I think their behaviour towards you is pretty shoddy.
