hi need your help got a parking ticket for parking on what thay claim was a public footway - there was double yellow lines around it. now the ticket says they observed my car for 2 minutes but i understand from my appeal letter (on a different point) which they refused that they must give a 5 minutes observation - could i appeal because they only saw the car there for 2 minutes?

Difficult to comment without seeing the paperwork. However, what I can say is that the only observation that is requires is sufficient time for the CEO to have reasonable grounds to believe that a contravention has taken place. This can range from no time at all to a few minutes but the law does not proscribe a definitve length.

Unlikely to succeed on appeal, if that is to be the sole basis of your appeal. You are not entitled to 5 minutes observation time. Since the car was on the pavement, the CEO may have decided it was not necessary. They may have decided that two minutes on the pavement was enough - after all, what are they observing for?

not sure but there letter states somethuing like "the law states they have a five minute observation".... (dont have letter with me)

 

but they observed for 2 minutes.
