    • Hi guys, After the 14 days extension as expected received a response that Evri has rejected the claim I'm attaching their defence. How does it read? From what I can tell it looks very similar to their 1st parcel defence last year, except from what I notice instead of accepting the parcel is lost they are saying they don't know as it's been over a year so they dont keep tracking records that far. Pretty scummy for them to do that since Judy Cobett is well aware from our emails that they did lose this parcel and the reason why it's been over a year is because I waited until they settled and paid on the first parcel before starting this claim on the second. Anyway, I have all the emails and postage evidence if they wierdly want to use that as an angle? The other difference is this mammoth list of dates they can't attend. Last time the list was 14 dates.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As the title states can anyone give me any information on the complaints procedure against an Orthadontist please.

Also I may be looking for compansation for my daughter, how can I do this.

Any help/information would be good.

I will try and be to the point.

My daughter had a brace fitted nearly 2 yrs ago, at the time there was 2 orthodontists at the practice, within 6 months the one treating her left, which left only 1.

They had no replacement so my daughter was transfered to the other.

Over the months her appointments where cancelled and she went as long as 12 weeks which we have now been told is unacceptable.

Her last visit at the beginning of the yr included bands being fitted, well as before she went 18weeks between appointments due to cancelations again.

When she finally got in to see a temp Ortho she was told that the bands had been on way to long, thus causing 2 of her teeth to fully rotate.

Of cause we were not happy and got PALS involved who organised for us to swap Orthodontists.

When we finally got the first appointment with the the new Ortho, he as said he can not treat her because she needs to see a Ortho specailist.

Reason, she had 2 teeth removed at the start of her treatment which we have now been told was not needed,2 teeth have fully rotated and her teeth have now over corrected:-x

The complaints procedure will be available from your PCT (primary care trust), IMHO you will need to push to see the specialist ASAP, have you been told where he/she is based.

Yes the new Ortho who said he could not treat her, as written(yesterday) to the specialst, so it is a case of waiting, we have contacted PALS but she is on holiday until Tues, only 1 that works in our area for this issue:rolleyes:

So it is a case of waiting again, but if it is to long we will persue a private specialist which the original Ortho will have to pay.

PALS have contacted us today and said they have had a meeting with the contracters about this Orthodontists, because they have had 16 complaints.

They have come back to us with the comment, they have a new Orthodontist starting Oct do you want to go back:-x

Ho yes they have F***** my daughters teeth up so we will go back:shock::rolleyes:

We have now left it for them to contact the specialist, to speed up the appointment.
