    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Absolutely fantastic site, thank you for your advice and inspiration.

I have been following some threads for a while now and have found them to be a great help. We have currently come to a standstill and am looking to see if anyone has been in the same situation. We have received the standard microfiche letter, as many have, and towards the end of the 40days sent the template microfiche letter. We received a letter back last week to say exactly the same thing. Letter from Pam Speed to say we will send out microfiche statments in due course, they are not covered under the DPA blah, blah, blah. We have already had this letter once! So I called the number on the letter to find out when due couse is and was told it could take up to 4weeks. I was quite prepared to wait until I realised they had cashed my cheque over 4weeks ago and Pam Speed originally wrote to me 5weeks ago! Starting to pull my hair out now, has anyone any suggestions please?

Still no luck, sent template 2 non-compliance of DPA letter a couple of weeks ago saying if thet do not supply the info within 7 days I will take them to court. Made two telephone calls, the first time they said it could take up to 4 weeks (which had already passed) the second time they said they have a huge back log as lots of people are doing the same thing and don't know when I will receive them! They cashed my cheque at the end of June, starting to wonder if I will ever receive the statements, surely if I have paid for a service they should deliver. Don't really want to go down the court route just yet as I can't even begin to estimate how much they have taken, should I just hang on for the statements? I started this procedure about 10 weeks ago, is it normal to have waited this long?

OMIGOD!!!!

 

Actually received the microfiche statements today, after 11 weeks of waiting! Never thought they would come.

 

At least now I can really get the ball rolling, will be sending out the prelim letter asap.

Can you believe it though we are still waiting for one statement!!!

 

Does anyone know how far back you can go by looking at statements online? Just registered for internet banking yesterday but SURPRISE, SURPRISE I will have to wait at least 5 working days before I get my registration details through.

 

Have written the prelim letter anyway ready to send when I get the last statement details. :mad:

Well I called them AGAIN last wednesday and they said that I should receive the statement within 5 working days, so should have it in 2 days time! I'm afraid I've heard it all before though and I am very doubtful!!!

Hi, just got back from holiday and found a letter from shabbey waiting for me. The letter offers a 'goodwill gesture' of £100. Obviously I would still like to proceed for the full amount but the letter they have written doesn't say what to do if I am not happy with this offer. What should I do if £100 appears in my account? There wasn't a cheque in the letter they sent.

 

Does anyone know of any template letters I can send to say 'no thanks, I want the full amount?'

Hi again, found the template letter in the library section of the site, will write that up tonight and get it posted tomorrow.

 

Guess what??? They paid the £100 into my account overnight so I will make sure that in the letter I say that I am accepting this as part payment but still want the full amount!

Hi everyone!

 

Does anyone know if I should write the schedule of charges including interest using the fantastic excel spreadsheet then just minus off £100 from the total and in brackets explain this is the amount already refunded. I think this may be the best way of doing it as yes they have given me £100 but what about the interest on that amount? Does anyone agree?

Hi everyone,

Just a quick update really as I haven't logged on for a while...

I received the bank's defence yesterday saying that the charges are not a penalty and that the charges ARE infact proportionate to their costs and the banks losses. Just wondering does everyone receive the same defence (I don't want to be the odd one out)?

Also with the defence I received an Allocations Questionnaire, so will get this filled in asap and send a copy to the bank too.

Will be back when I have further updates but any advice on what their standard defence is will be greatly appreciated. Off now to read a few other threads. ;)

Thank you, that's quite interesting I've never seen that before. Is that basically saying that I will submit my court bundle within 14 days? My local county court are currently setting small claims hearings for March, so unfortunately it's still a long way off! Hopefully this should speed things up though. I'm usually quite good with legal jargon but not sure I have the jist of this one, obviously I need to be able to understand it before I send it, sorry if I'm being a complete doughnut! :razz:

Hi guys,

 

Received offer from Abbey yesterday for half the amount owed. The letter said 'without prejudice', I think I read somewhere that this means I can't discuss it or present this letter in court, is this right? Also do I send them the same letter as I already have done when they refunded £100, the 'thanks but no thanks' letter?

I had a good laugh when I read the letter last night, kept mentioning that they weren't admitting to anything and of course I had to pay something for the service they've provided!!! ;)
