Hi

I'm trying to help a friend sort out her debt and she just received a default notice stating 7 days to clear outstanding balance or she'll have a default on her credit file.

 

Her problem started when she went 72p(Pence) over her overdraft limit with BoS, she got a ridiculous amount of charges smacked on top of that (well over a 100 pounds by now) and as she is on JSA she couldn't afford to pay up! she went to the bank and was told that she would have to pay a certain amount a month which she said she couldn't pay but could pay 2.50 a week so 10pounds a month the bank person said that would be considered at least a good will gesture or whatever she called it, but seems BoS wasn't happy with that and have continued to charge her once a month and have now sent the default notice.

 

thing is because my friend has been paying 10 pounds a month for the last 3-4 months if she hadn't gotten all those charges she would actually be 30-40 pounds under the limit(as she only went 72p over in the first place)

 

I have been looking at letters for claiming back charges and am gonna send one off tomorrow but I don't know if I should include a passage saying that since she has, charges aside, long paid off the overdrawn balance, that there shouldn't be a default issued against her file since the charges are "disputable" and how would I word it?!
