    • Yes all works have been completed and we have only just received the final report from Mercedes today (we have had numerous communications from them including photos and videos of work being completed) I can see now in the letter that the word “quotation” was used but this should have read invoice. Doves have been kept aware of the situation and have been in communications with Mercedes themselves, so they are already aware the work was being commenced. 
    • Hi all,   I didn't expect to start really badly with pucharse my new vehicle. 8th June I buy the vehicle from BigMotoringWorld. The car has 10987 and apparently service was done on 10852 mileage . I spend half day in the store to take the car and was even manipulated to buy warranty with is cost a lot money.   Since I left the store car has start to having issues with the breaks. Once i pushed break pedal car starting noising and don't have like power to stop the vehicle ( Pedal must be press to the end to stop )   I start to call them but no one was able to support they was just close the phone... So i decided to read the review about them and I was shocked... I take the decision I will return the vehicle and send them email on 12 June with the issues on breaks and request to return the vehicle. They reply to me 5 days later  In relation to your request to exchange your vehicle, please be advised that we do not have a returns policy on our vehicles. Please can you confirm how the vehicle is noisyssss I was really angry I have to deal with them and car was cosr me £31000 + finance cost so I read your posts in forums and took some advice from others colleges who have similar issues and reply to them as below.   Dear Big Motoring World   I'm writing to you about the car I bought from you for £31000. on 08.06.2024 The car has only 11000 mileage I was thinking is almost brand new however has issues with the breaks. In order to complete our investigation we require some additional information from you. please confirm the following at your earliest convenciance: Please can you confirm if you have visited a local Halford or Kwitfit or other repair agent to carry out a free of charge break health check ? Halford and Kwitfit are able to check your breaks to advice if they require replacement.   In order for me to issue to my response can you please confirm your desired resolution ?   If you feel I have not understood the nature of your complaint correctly, please advise me accordingly.   We will now be investigating this complaint and will aim to respond to you as soon as possible.     • Yes but it was for a debt that never existed but to come to the door was a step to far as my wife was quite frightened by it. He showed her a badge like he was official and wanted to talk in private. But after speaking to me she closed the door behind her and told him to post any letter.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all i'm looking for some help if possible.

 

Yesterday i purchased a HTC Hero mobile phone on a 24 Month Contract with Orange i was told that i would get Orange maps with Sat Nav for this handset FOC. So i get home last night attempt to set up the Sat Nav service and find out that the phone is not compatible with the service.

 

I attempted to return the handset and cancel the contract as none of the other handsets in the store were suitable to me, i am then told that i can not cancel the contract and return the handset.

 

Surely i must have some rights to return this handset????

 

Help please people :(:(:(

Two thoughts - this was an upgrade, or a new contract?

 

If the latter, was the decision to get the Hero led by you on advice from the staff, or did someone there at the shop specifically tell you that the mapping service was provided FoC? Finally, WHY is it incomparible?

Hi thanks for the reply, yes it was a new contract, the sales assistant did promote the orange maps sat nav as being available on the Hero however it has transpired it's not!!!

Since your decision to purchase was based on the information provided by the sales staff, if the phone does not work as promised/claimed by them, then you have every right to reject under SOGA - as your need for the mapping program was part of your decision to purchase the contract/handset. (You only have 14 days to repudiate the contract).

 

Are you sure the service isn;t really compatible? I cannot imagine Orange launching a new handset then not supporting it with their promotion.

 

UPDATE: I found out why.

 

Up until the Hero - all HTC's handsets used Windows Mobile OS as standard. The new Hero ISN'T a WM handset, but one using Android - Google's New Phone OS. And naturally with a new OS, all standard software is going to be OS specific, and Orange Maps won;t be available until they do an Android front end. If mapping is a deal breaker, then you'll have to go to another HTC. If you can await until they get the client sorted, you might not have long to wait!

 

As for the staff error - it is an easy mistake to make, not ideal, but a mistake nevertheless!

Anytime. I've just heard that the (rather excellent) Co-Pilot GPS Phone software is now available for Android handsets for £24.00 - so another solution would be that if they cannot provide you with Orange Maps for Android, they should give you a £35 credit so you can get the Co-Pilot equivalent.

 

If they refuse to deal with you, then you need to get the address for escalated disputes, explaining that you will then return the handset (via Special Delivery) and will ewquire the additional cost for doing so to be reclaimed from them as part of your refund.

Already took the phone back into the store the day after purchase and because the manager wasn't there they wouldn't do anything but basically the assistant manager tried to fob me off, they were very rude as well. I walked out the store and left the handset in their possesion.

 

I want the contract cancelled their customer service is disgracefull, they even tried to lie to me and say that they only said the contract had the maps service and not the handset!!!!

 

I don't want the co-pilot equivalent they haven't delivered on what they promised

Naughty. Not all the phones support the Mapping service (as you know), so trying to sell this as a 'benefit' of the contract - when you cannot use it, is a pretty lame excuse!

 

Exactly so they can offer me a tomtom satnav for all i care i wouldn't accept my so far short lived experience with Orange hasn't been good

You could say that for all networks, really - but dont escalate your distress out of all proportion. It was an error that this HTC handset cannot use the mapping service. If they can confirm it will be available on Android in (say) 28 days, your argument is considerably weakened, as the pone would then do what the salesman suggested.

 

I'm assuming your using this as a 'get out' because you don't actually like the handset?
