      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Credit Today understands that allegations include collection professionals putting undue pressure on vulnerable debtors, making premature threats of bankruptcy and chasing third parties and statue barred debts.

 

You'd think their industry website would get it right wouldn't you??? :D

Anyway...I think it's awful that debts shouldn't be able to have statues.

I'm thinking of having a statue of Dick Turpin for mine...

Hi Beachie..glad you're back :)

Tried posting my 'experience' with a couple of dca's on the C4 website together with a huge plug for CAG & Truecall, sadly it hasnt been posted.

 

My first one didn't go on yesterday so I did another this morning which went on OK....if at first you don't succeed...:)

 

I'd be interested to know how many new members we've had since CAG was first mentioned by Mr Ton :D

 

To Suziwong..very well done honey and let those hormones rage..there's nothing as formidable as a pregnant woman on a mission! You're a star :)

Looking at the offering on the Dispatches site from "Honestlass" her attitude beggars belief.

Are we dealing with the pod people? :eek:

They obviously brainwash their staff into believing the rubbish they spout. Her post just serves to prove, not disprove our side..just how arrogant, ignorant and argumentative these unprofessionals are.

If you stop paying your creditor without warning and then refuse to make a reduced plan they will sell the debt. So what? Personally I found debt collection companies more courteous than the banks! Most debtors are not the vulnerable, they simply do not want to change their lifestyle that they know now they cannot afford. Finally, I find the debt forums to simply exist to discuss ways to avoid paying your debts, irresponsible or what? The Consumer Action Group is appalling, they think debt avoidance is to be admired!

I just watched it on 4OD, to mixed feelings.

Overall, great that they have been exposed for what they are..and in reality I feel more research would have unearthed much worse behaviour and scenarios.

However I agree with dx100 and others in that they left the programme hanging with the impression that there was nothing you could do about it, which could leave many people feeling even MORE frightened of them than they were before.

For a balanced journalistic view alone, the programme should have included advice on consumer rights and how to deal with these companies. I was waiting for a "if you have been affected by the issues covered in this programme...." announcement at the end, with helpline numbers. Nothing came up on 4OD...I take it nothing came up live either..which is rather shocking.

Hey ho, good and bad publicity for CAG, hopefully many new genuine people in need of help will find us through the Dispatches website...but watch out for fakes as their ire has been raised, and no doubt there will be trolls in abundance, so beware of PMs or requests for email addresses etc dressed up in any form. :rolleyes:

Hear hear HAK, but newcomers please be aware we don't advocate debt avoidance on here.

What we do advocate is empowering yourselves to deal with your debts, and debt collectors, according to the law. If whoever is chasing you goes by the book, and all your documentation from the bank is in order, we can point you in the right direction to get free, managed help from a debt management organisation.

If your documentation, eg loan agreement, is missing or faulty, if you have had unfair penalty charges added to your account, or if DCA's break the rules..we can advise, but ultimately it's your decision how to proceed.

Most of all, though, whatever your circumstances, on here you will get NON JUDGEMENTAL support, a warm welcome and new friends who understand your problems...because they're in the same boat.:)
