After spending the last 7 months chasing money from our insurance I have just reached the end of my tether after their latest action and I could really do with some advice.

We had a house fire last year which destroyed virtually all of our possesions and was very stressful as we had a 9 month old baby.

Our insurers passed our claim onto a 3rd party loss adjuster who then passed our housing needs over to another 3rd party specialist. We finally found another house to move into and the housing agency thrashed out a deal on the rent and the deposit. We were told that although the deposit was to be paid by the agency it would form part of our

settlement and would come back to us and therefore if we caused any damage in the rented house then it would be coming out of our own pockets. The deposit was then placed in the deposit protection scheme under my name.

We are now back home and it is 8 months since the fire and only in the last week didwe finally get the final settlement cheque which although wasn't as much as I had hoped for as far as I was aware I still had the deposit to come back. We haven't yet claimed the deposit back as we are still waiting on a reciept from the water board to show that we have paid all monies owed.

Imagine my shock when I recieved a phone call earlier from the letting agent to say that the housing agency had been in touch asking for their deposit back. I rang the loss adjuster to find out what was going on and

he now denys telling me that the deposit was part of our settlement and that the deposit belongs back to the insurance company.

The worrying thing is that if the water board

hadn't dragged their heels over the final receipt then I would have already claimed this money back from the dps and most probably spent it. Do I have a leg to stand on

here as the money is currently still sat with the dps in my name and if it wasn't supposed to be coming back to me then why did the agency allow the letting agent to keep it in my name and not insist that it is held in their name as they cannot get it back until I agree to sign it over.

This has been so stressful and I finally though it was all over until today.

Any advice is appreciated.
