I have a question that needs attention, been looking fot the answer on the site but cannot find it.

 

If you have been issued a default notice on a credit account or loan account, is it still possible to challenge a creditor for unenforceable credit agreements?

I am quite new to this forum and this subject matter, and find your comment about my ability to see very rude!!!

 

If I cant ask what i think is a valid question then whats the point.

 

My question arose from an old thread I had found while googling and seemed to suggest this:

 

A judge has concluded that once an agreement has been defaulted then section 78 as no relevance so in effect the creditor need not comply and more worryingly because the agreement is at an end the creditor may still obtain enforcement, thus, losing the protection of 127 (3).
