      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I wonder if anyone could advise?

 

My Eldest son unawares to his Dad and I used Our address to have Debt Recovery Letters forwarded from Phillips. He has never lived here for over Five years after we asked him to leave. As far as we know he has settled in another part of the Country but we have no further contact with him through stress he has caused us.

 

Months ago I let Phillips know of this after I opened a letter from Phillips to see why I was getting so many from the Recovery Department. I was told quite Cheekily by one of their reps that I had No right to open his mail..:mad:

How dare she? This is my home and I had a right to know why I was getting these letters and phone calls on a weekly Basis.

 

The phone calls have started up again, every night at 6pm with a recorded message to ask My son to contact them or they will send out Bailiffs. I am besides myself with worry.

 

His name is not in this address and I don't know what to do next, how many times have I got to explain this to them before it finally sinks in?

Start recording your calls. this is an essential step when deaing with these bullies.

 

Write to them special delivery and inform then that your son is not living at your address. you have no duty to give them any information as to where he might be.

Keep the recorded messages. If necessary record them onto somthing else - with the help of a micophone if necessary.

 

They cannot send bailiffs if there is no court order and to threaten to so so in this way is an unfair commercial practice

Phillips are currently contracted to collect parking tickets on behalf of City of Westminster and they do indeed use this method of making contact and I am aware of many complaints that have been made by members of the public concerning the methods of enforcement with many such complaints being made to the OFT.

 

However, more importantly, they are also contrated to HMCS to enforce unpaid Magistrates Court Fines and this is possibly what they are enforcing in this case. It is vitally important to ensure that you WRITE to this company to make them aware that your son does not live at the property.

They are quite correct - you have no right to open another person's mail. It wasn't being cheeky of her to say so (although the way she said it may have been impertinent). All such letters should be returned to the sender.

 

On the other hand many of us have been guilty of opening mail pushed through our letterbox without bothering to look at the addressee's name, only to find it wasn't for us.

 

You mention your 'right' to know why you are getting these letters. You don't have any such right - are you sure it's not just curiosity?

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

True, without a doubt intereference with the mail is an offence.

 

Interference with mail - Postal Services Act 2000 Sections 83 and 84

 

The Postal Services Act 2000 sections 83 and 84, see Stones 8 - 24243 and 8 - 24244, create offences of interfering with mail. Section 83 is aimed at persons engaged in the business of a postal operator and creates an either way offence. Section 84 covers any person and creates a summary only imprisonable offence. Both sections cover intentional delaying or opening of a postal packet and intentional opening of a mail bag.

 

My dog however doesn't know that and can't read, and neither can my 3 year old grandson, so if any mail comes through that has been errr, damaged by them......then I'll just check what's in them to identify who it's meant for.

 

As with almost everything, it's the intention that counts, the "mens rea" ;)

As it happens Mr Bloody Know it all... Don't you DARE suggest I have opened these Letters out of Curiosity, I have been worried sick... I have lost sleep AND Plus my appetite ..worrying about My eldest Son.. and when I receive threatening phone calls and Continuous letters coming through my letterbox ,YES i Have a right to find out about it! Do you live on the same Planet as me??

 

I have a right to investigate anything that threatens my familys home..

 

I have sent Umpteen letters back, that is my point! I am fed up with the worry of it all and yet I come on here for advice and get Total Bollox advice from the likes of you.

 

Aghh..You should feel ashamed of yourself, what you doing on here? Your no help at all? Holier than thou springs to mind?

Just to put the Record straight as well...My youngest Son has the same Initial as my eldest son so most post is confusing... Is that STILL being NOSEY??? I am disgusted with the remarks you have made when I simply came on here for help when I am very upset!

 

I hope you need advice one day and people tell you to do one!

Wow!

 

Missy you are being a bit hypersensitive here.

 

Palomino is only stating the obvious, OK it could have been put in a different way, but anyone who isn't just a little bit curious about the contents of a letter put through your letterbox simply isn't human.

 

Unless it's a genuine mistake where the postie has simply mis-delivered a letter or parcel, I would be curious about the reason for frequent letters coming to my address, anyone would, there's nothing wrong with that.

 

Some years ago we bought a house that was getting mail for 14 different people that I know had never lived there, after sending them back NATA for a while I started wondering why they kept coming and began opening them.

I found that foreign people from the Yemen were using my address to get NHS services. Immigration couldn't care less, neither could the NHS; I found it mystifying.

 

Then there was the van log book that came, correctly addressed to our house with someone else's name on it. Of course it was dodgy, and only my curiosity prevented the fraud going any further using my address.

The dealership responsible was very keen to get the logbook back, they never did, it was sent to the DVLA with a covering letter, they probably couldn't care less either.

 

It's not what you tell 'em that counts, it's how you tell 'em :D

Sadly, I'm not ' Mr Bloody Know it all'. Wish I was.

 

I've spent more than 2 1/2 years and counting going through this sort of trouble so I have some idea of the feelings you're experiencing.

 

Your posts suggest you are very stressed and therefore volatile. I know the feeling very well as I went through this myself and had to have treatment for depression. In that context I was trying to separate facts from opinions and feelings. You may have a moral right to know why you address is being used but you have to sit back and dispassionately assess what can be done. Remember the old adage : revenge is a dish best eaten cold.

 

As for 'Total Bollox' then you are perfectly entitled your views - and I would even defend your right to hold them. People make comments and others respond : sometimes there's a mismatch somewhere.

 

As for not caring, I think you are little off track here. I do care, and quite a lot. Sometimes I can even help as others here will testify.

In all cases though I try and comment without taking an emotional standpoint (although I can do emotion if you wish:)).

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.
