      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all.

 

After watching our Trev on the telly, I decided to look into the money I have spent over the years and I have sent charge requests to Northern Rock, Halifax, Lloyds TSB and Barclaycard.

 

I will keep you updated with my findings charge wise. There are plenty of institutions left for me to explore such as Lloyds TSB Credit Card, Loan, Citifinancial, you name it but of course i dont want to complicate things at the moment.

 

It is interesting to note that my letter send 2nd class on 06 June was replied by Northern Rock the very next day and I have since discovered £200.00 in charges has been paid (including £120.00 on 1 day for returning 4 items) hardly in line with actual cost methinks.

 

I have sent Northern Rock my letter and will see if they wish to settle now or at the small claims court. I will persue this to the bitter end so lets hope for their sakes that they want to get it over and done with now.

I must forewarn, get your complaints in now for tomorrow could see pressure by the banks to close our arguments!

NR responded on 15th with a "your complaint is being dealt with".

 

I called them today (21/06) and I was told with it with their legal team.

 

Legal Team, if you are reading this, I am going all the way!:) :o :)

After receiving a rather harsh reply, I proceeded with moneyclaim.

 

NR have today acknowledged receipt.

spoke to Lynn Matthews, lovely lady, asked her what is happening, court hasnt sent her a blue form so they have asked the court for it.

 

what is a blue form???

 

she will update me whether we are going to court (lets hope so, I am ready!) or just settle.

well others seem to get their Northern Rock monies straight away after the claim is acknowledged. Seems like NR will be joning me in court (rubbing hands).

Is this common, my moneyclaim has turned to DEFENCE

 

Defence

You are unable to take any further action online on this claim.

 

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

 

Of course I will go to the bitter ends anyway, but was expecting a payout now as per others!

Don't worry. More banks are getting to this stage now. They're trying to scare people off and go as far as they possibly can before they give in. You might find that you get sent an allocation questionnaire by the court. Just fill it in and send it back. They'll probably give in soon after that.

went to NR with the NR cheque and asked for the cash, was told it would take 4 days to clear.

 

i asked (in front of everyone) if NR was worried that they didnt have £300.00 in the deposit account and was worried NR would bounce their own cheque.

 

also pointed out interest accrues each day the cheque in uncleared. if they want it settled, it would have to be cash,

 

walked out having closed my account with a wallet full of money

Hi,

 

I have just sent Zoot's letter with the tail end of the template LBA giving them a final 7 days. They replied back today, it has been passed over to their legal dept.

 

I think LM is either a sarcastic, rude, frustrated old bag or a fat blonde carpet muncher? Take your pick.:-x

 

Are you now saying that NR have settled your claim instead of going to court?

 

I hope so. :lol:

just checking again on whether NR have settled your claim or gone to court? It has been over 2 months since your last post. If you have been persuaded to sign a confidentiality form, just reply to me and say so and I will take that as a success on your behalf wiithout you having to divulge any info.

thanks for the quick reply. I have just re-calculated all of my charges and intend to fill in Moneyclaim form on line tonight. I just needed some reassurances that the BANKERS have paid claims out?
